Charges against Kan. abortion doc dumped [George Tiller]

WICHITA, Kan. — Kansas' attorney general, a vocal abortion opponent, charged a well-known abortion provider with illegally performing late-term abortions, but a Sedgwick County judge on Friday threw out the charges after less than a day.

Judge Paul W. Clark dismissed the charges against Tiller after Sedgwick County District Attorney Nola Foulston said her office had not been consulted by Kline.

Clark signed his one-page order only hours after Kline's complaint against Tiller was unsealed.

Attorney General Phill Kline's office did not immediately return calls seeking comment. Kline lost his re-election bid in November and leaves office in three weeks.

Most of the 30 misdemeanor counts Kline filed against Dr. George Tiller involve abortions performed on patients 17 or younger, including a 10-year-old, according to the criminal complaint unsealed Friday in Sedgwick County District Court.

Tiller's clinic, known for being one of the few in the country to perform late-term abortions, has been a high-profile target of anti-abortion protesters for decades. The clinic was bombed in 1985, and Tiller was shot in both arms by a protester in 1993.

Kline has been investigating whether Tiller and other abortion providers performed illegal late-term abortions in Kansas or failed to report suspected child abuse as required by law.

He waged a two-year legal battle before finally this year obtaining the records of 90 patients from Tiller's Wichita clinic and a clinic operated in Overland Park by Planned Parenthood of Kansas and Mid-Missouri.

Since the election, abortion rights activists have expected him to move against Tiller and perhaps Planned Parenthood, as well.

This is societal derangement. Tiller actions are horrifying, the fact the government allows it to continue is anarchical.

I too had the same reaction and decided to search the Internet for confirmation. I found it on Tiller's website.

I'm very troubled by the sense of National paralysis. We know this behavior is absolutely wrong, but it continues and the lives of the innocent are not spared. Why do these women allow this to happen to their children? Why are the fathers silent? This is animalistic and I regret this abject subdivision of our species bears the undeserving title of humanity.

To adorn the killed babies with ceremonial clothing and provide rights of passage into a religious faith is simply pathological. Tiller is facilitating a value system that devalues the welfare of maturing babies to that of clinical waste and then masquerades behind superficial sensitivities. He is only but one of many who exemplify this flawed characteristic of civilization. Is it a stretch to imagine an abortion package where Tiller performs a sacrificial kind of abortion using a mock alter and dressed in tribal witch doctor attire? Would this not be fitting in our 'diverse' society that aims to please anyone in any way whatsoever, and not to forget, at any cost?

This fight on behalf of the innocent is not the exclusive responsibility of the faithful. To those that contend the cause of defending the innocent is not a cause for all of humanity, you are fatuous.

The incoming attorney general, Democrat Paul Morrison, has criticized Kline for seeking the records, describing it as an invasion of the patients' privacy, but he wouldn't say if he would drop any investigation Kline started against the clinics ( from the article)

It does sound like an invasion of privacy to grab medical records of private citizens without their consent.

Guess what. It happens all the time in the WoD. Adjudicated and approved long since.

I can't even wrap my mind around the fact that I am reading this statement on a 'PRO-GOD, PRO-LIFE' forum, on an thread discussing an ABORTIONIST (and those who support him) who DENIES BABIES THE FREEDOM TO LIVE THEIR LIVES, and that this statement is directed against PRO-LIFE FREEPERS who would put an end to this butchery.

Are you referring to abortionists who deny life to younglings? Or, those who wish to deny abortionists the freedom to practice the denial of life?

Please clarify. I'm confused as to which side of the bloody red line you stand?

What about children who are under age? Can a doctor that does nothing but abortions really verify that the childs parents knew and approved?

The issue here was solely whether or not statutory rapes were being covered up by adult men who fathered babies with underage girls.

Agreed. I think this is rampant.

But it doesn't seem to be the main focus of the investigation in the article...

Earlier this year, he obtained the records of 90 patients from Tiller's clinic and a clinic operated by Planned Parenthood of Kansas and Mid-Missouri.

Under Kansas law, if a woman wants to obtain an abortion after the 22nd week of her pregnancy, a doctor must first determine whether the fetus can survive outside the womb. If the fetus is viable, the procedure can be used only to preserve her physical or mental health.

None of the abortions involved a late-term procedure opponents call "partial birth" abortion, Kline said. The charges involve situations in which Tiller cannot demonstrate that a woman faced permanent damage to a major bodily function, or Tiller's conclusion that some patients' mental health would be harmed if they did not have abortions, Kline said.

Disregard for the Constitution? He had subpeonas for those 90 records. That means a judge signed off on them being turned over based on the evidence Kline showed the judge.

What part of the Constitution do you think was disregarded?

very simple, she is a liberal dem that never heard of an abortion she did not like.

I can not understand why we can not get rid of her. I don't remember the last time anyone even ran against her.
