Lab in lacrosse case found many DNA sources (DUKELAX)

A private laboratory hired by the prosecution in the Duke lacrosse case failed to report that it found DNA from multiple males in the accuser's body and underwear, according to a defense motion filed today. The lab, DNA Security of Burlington, found that the DNA did not match the three defendants, their lacrosse teammates or anyone else who submitted their DNA to police, including the accuser's boyfriend.

The new evidence emerged in thousands of documents handed over to the defense in October.

On April 8, 9 and 10, DNA Security found DNA from multiple males on the panties and rectal swab from the rape kit; none matched the lacrosse players.

On April 10, Meehan met in his office with Nifong and the two lead investigators in the case, Sgt. Mark Gottlieb and Investigator Benjamin Himan.

On April 18 and 19, DNA Security ran tests on pubic hair from rape kit; multiple male DNA was found that did not match the players or any other sample taken by police, the motion said.

On April 20 or 21, Meehan again met with Nifong and the two investigators in his Burlington office.

Meehan included none of these DNA results in his final report to Nifong on May 12.

The report violated DNA Security's own policies, which state that reports shall include "results of every DNA test," according to a copy of the policy filed with the motion.

The motion, signed by attorneys for defendants Reade Seligmann, Collin Finnerty and David Evans, complained that the information was not disclosed in a report on the testing prosecutors provided earlier this year to the defense.

"This is strong evidence of innocence in a case in which the accuser denied engaging in any sexual activity in the days before the alleged assault, told police she last had consensual sexual intercourse a week before the assault, and claimed that her attackers did not use condoms and ejaculated," the motion read.

In an interview, defense attorney Joseph Cheshire said the report's findings suggest the accuser had sex shortly before the March team party where she was hired to perform as a stripper. The woman has said three lacrosse team members gang-raped her in a bathroom at the party.

"None of (the DNA material) happens to be from lacrosse players who are supposed to have had sex with her, which is pretty significant," said Cheshire, who represents Evans.

District Attorney Mike Nifong, who has generally refused to talk about the facts of the case since granting a flurry of interviews in the investigation's early days, did not immediately return a call seeking comment. Defense attorneys for Seligmann and Finnerity either declined comment or did not immediately return a message.

Seligmann, Finnerty and Evans were indicted by a grand jury but have all strongly proclaimed their innocence. A trial is not expected to start until spring.

I feel so sorry for the boys involved in this. I hope their parents have the means and the desire to sue until the cows come home to clear their names and let them get on with their lives.

If all of this proves to be a set-up, that jerk Nifong deserves a lot of prison time.

It's amazing the lengths to which Nifong has been allowed to go to attempt to lynch these boys purely to ensure his reelection.

I predict Nifong goes on with the prosecution. He is in too deep to back off.

That happened in the Don Adams case in Philly - where Lynn Abraham charged him with assaulting the fists of Teamsters with his face. She took it to trial. The judge laughed it out of the courtroom. Lynn Abraham, however, is still Philly DA, which doesn't give me much hope that justice will be served on Nifong.

COWARD...is the only word that comes to mind when I think of Nifong.
I think we should start a new word; as in "that guy is such a 'nifong' for doing nothing as that woman was mugged."

It sounds like this skank collected semen like some people collect baseball cards. Maybe someone needs to test Nifong or at least book this tramp on Maury Povich.
