The ruling does not apply to illegal immigrants who use false documents or otherwise lie about their immigration status to get jobs. But the decision, by the 2nd U.S. Circuit Court of Appeals, says illegal immigrants are covered under New York's "scaffold law." The law allows injured workers to sue contractors over unsafe work environments.

And didn't this particular illegal ALIEN use false documents and lie about his status? They all use false documents and lie about thier legal status, how can this idiotic judge make a ruling like this?

Assuming this ruling stands, then illegals should be able to sick the DOL's Wage and Hour cops on employers to collect full minimum wage plus overtime. And they can probably sue for entitlement to worker's comp and other benefits.

NY sect 230/231 of the labor law is the instant lottery for any "gravity related injury".

It is the single most abused labor tort law in the nation, and NY is the only state that still has anything like it on the books.

There is NO defense. the employer/property owner/GC/subcontractor loses automatically.

Even criminals breaking in and stealing from a construction site have won money lawsuits (and big ones) under these 2 idiotic laws.

Excuse me, but doesn't this make this a non story. If you use false docs, you are screwed and rightly so. The vast majority do this to secure the job with false docs.

When a federal court issues an idiotic statement, the other two branches of government and the public should be able to simply ignore it.

If they are here ILLEGALLY, and they are working here ILLEGALLY, they should not be entitled to ANY protection of the law.

This might actually be a good thing. If the workers are covered under the employer's worker's comp coverage, insurance companies might start putting provisions in their policies denying coverage to people not legally allowed to work in the US. If illegals aren't covered, these lawsuits will be settled out of the employer's pocket, essentially putting their businesses on the line? Would you be lackadaisical about hiring illegals if you knew you might lose everything?
