Fake in that the sense of a police informant 'entrapping' a suspect. Foley did type the words, but was doing so as a result of encouragement from the intern. All the IM's have not been revealed yet, so we do not know if the intern sent a previous 'suggestive' IM or two to Foley to make him think he was gay and/or interested in Foley

Entrapment?

How is this different than a cop pretending to be a 14 year old girl on the internet? Is that entrapment?

Only different in the sense you dod not know what the intern said first. If a cop were to type that he is a 14 year old girl who wanted to give the guy on the other side of the computer oral sex, it would indeed be deemed entrapment by a court. We do not know what the intern said first to elicit those responses from Foley and the intern was 18 at the time.

that gets into a grey area of the law - and to be honest, I don't think Foley's actions are going to be sheltered by the "entrapment" concept.

but some people are legimately entrapped - John DeLorean for example.
