As long as we're dealing with a lawyer here . . .
Maybe what he really means is that Foley has never had any sexual contact with a miner.

I wish people would stop defending this creep's behavior.I wish we would quit talking about Freak'n Foley, period. He, himself, is history and good riddance. What we need to be talking about is how we got set up. It ain't about Foley now. It's about the GOP and surviving this.
To: brytlea
This is why the lawyer said Foley is a gay man. It was to steer the perceptions away from pedophelia and "mainsteam" it a "gay man" conduct, rather than pervert conduct.
FWIW.

Yes, I wonder how good his information really is though. Sometimes rumors are unfounded.

As Clinton wagged his finger in the nose of every American, assuring the world that he "did not have sex with that woman", he and his closest advisors knew better. As he sat under oath before a court committing outright perjury before a world-wide audience, Democrats stood firmly at his side, crying foul, insisting that any lie about sex isn't a lie at all really. When former New Jersey Governor James McGreevey was busted cheating on his wife and family with a young male office assistant, Democrats again rushed to his side
Democrat Representative Barney Franks didn't get busted sending private messages to his boy friend - he was busted paying a male prostitute for services. He was busted while using his elected position of power to clear his boy friend from his felony past, with convictions for cocaine possession, oral sodomy and "production of obscene items involving a juvenile."
Excellent points. Bear repeating. The MSM is jumping all over Foley (and they should) they way they should have jumped all over Clinton and McGreevey and Frank but didn't.

It ain't about Foley now. It's about the GOP and surviving this I agree. It's better NOT to play into the hands of the rats.

The ABC reporter Brian Ross leading the Foley charge is under FBI investigation for his role in the NSA leaks case.
There is talk that Ross will be indicted or will be listed in the leaks indictment as an unindicted co-conspirator.

In D.C., a 12 year and 1 day old can consent with a 16 year and 0 day old. The D.C. law is just plain wrong and needs to be changed.
The best chance of a conviction is probably under Florida law, Criminal Law Section
847.0138, by the way, if any of the IMs were sent while he was in Florida. A federal conviction will be tough unless he went across state lines to actually have sex with a minor, did a video chat with a minor or has kiddie porn on his computer.
Irregardless of the legalities, what Foley did was sick, disgusting and immoral, and nobody here is or should be making excuses for him.
