WASHINGTON The Supreme Court ruled Thursday that President Bush overstepped his authority in ordering military war crimes trials for Guantanamo Bay detainees, a rebuke to the administration and its aggressive anti-terror policies.
Justice John Paul Stevens wrote the opinion, which said the proposed trials were illegal under U.S. law and Geneva conventions.
The case focused on Salim Ahmed Hamdan, a Yemeni who worked as a body guard and driver for Usama bin Laden. Hamdan, 36, has spent four years in the U.S. prison at Guantanamo...

This is truly despicable. The Court has no authority to interject itself into this matter. These are illegal foreign fighters, captured on a foreign battlefield, detained and imprisoned on foreign soil.
If these guys want to be treated like POWs, let them wear a uniform, and fight according to normal rules of war.

Under UCMJ you only provide counsel if you press charges, no charges can be pressed, soo....they can be held indefinately...and they can be shot.
Does this mean that a non-citizen terrorist can enter our country, kill 10 million people, get arrested, play the court system and get off on a technicality or a hung jury; or appeal a guilty verdict for years and years?

It is interesting that you, who proclaim to be so concerned about checks and balances, about the overextension of the powers of government, particularly the federal government, should defend Roe v Wade, which has no textual foundation in the Constitution whatsoever, and was simply a case of seven justices imposing their personal opinion on the entire country, while overturning the laws of every state. So much for "the rule of law."

The SC, by the way, did not state that these folks would get fully procedural rights by American law.
The door is open for other procedures which go with prisoner of war status. That, of course, can mean detention until the end of hostilities. It is a very convoluted opinion.
