DURHAM, N.C., April 19 The lawyer for a Duke University lacrosse player charged with raping a woman at a team party said he had "irrefutable, independent evidence" that the player was not there when the woman says the rape occurred.
The proof includes cellphone records, a taxi driver's account, an A.T.M. record and a time-coded dormitory entry card, J. Kirk Osborn, the lawyer for the player, Reade Seligmann, said in an interview.
Mr. Osborn, based in Chapel Hill, N.C., said Michael B. Nifong, the Durham County district attorney, had refused to meet with him. Mr. Nifong continued to decline to answer questions from reporters Wednesday as he awaited new DNA results. Mr. Nifong said in a statement Tuesday that he was trying to develop conclusive evidence on a third suspect.

Unfortunately for the Duke students, Nifong has apparently taken to heart the adage that any prosecutor can convict the guilty, but it takes a truly talented prosecutor to convict the innocent.

I don't either. Kim's lawyer admitted to a FOX reporter that his client has changed her testimony from what she has said previously.
But I thought the "at least" in reference to the 180 degrees was comical. ^_^

Anyone could have used his cellphone, anyone could have used his atm card, anyone could have used his dorm entry card. None of that proves he wasn't there.
The cab driver is a direct witness, though.

According to his attornies, they have evidence from the ATMs that stamped his photo along with a timestamp that indicates he was at the ATM, not raping some black chick that identified her attackers by their scars. One of the first cops there admitted that she was drunk as a skunk when he arrived. She was hired from an 'escort agency' anyway, aren't those places basically pimps?
Anyone else think that maybe some of the boys at the party used some less than elegant language in front of the strippers, perhaps even the N word, and this stripper got upset and decided to make them pay in the only way she could think of?
I don't think she was sober enough to even realize what she was being called. I think with her priors she was worried about custody of her kids...
This case is making me madder and madder. I guess upper class white boys don't have rights anymore in this country. Yes they can hire attorney's but of course they are guilty - they are white and the alleged victim (I prefer to describe her as the lying stripper) is black so they are definitely guilty. She would never lie or make some sort of a hoax up. No the Tawana Brawley thing never happened either. Right. Just listen to every damn woman lawyer on all the cable news shows. The boys are guilty so let's just throw them in jail - that will make Jesse and Al and all the other virulently racist black "leaders" (I prefer to call them racial hustlers) happy. That's what this case is about - race and class. The lying stripper is a mother and a college student so of course she is a victim of white people - we are all evil.
This case reminds me a lot of the Scottsboro boys case of the 1930's when a crazy white women accused young black men of raping her and the system basically tried to railroad the boys. Well it's happening again only in reverse to a group of well to do white boys so nobody gives a damn. God help this country.

They have a lot of catching up to do with Nifong, who spent a lot of time mugging for the media in the first week or two of this circus. Whatever they throw at him, he deserves.

I think they are putting it that way since she is really employed by an escort service and they don't want to call her a "prostitute."
