SENATOR SESSIONS ON SECURING AMERICA'S BORDERS ACT

Mr. President, I thank Senator Leahy, ranking member on the Judiciary Committee.

I have received just this afternoon in my office some disturbing news in the form of correspondence from the Congressional Budget Office. It suggests a number of areas where the amendment we are talking about here today, No. 3424, the immigration so-called compromise, violates our budget and the rules of the Senate.

Let me read from the correspondence we have received. This is something, as you know, Mr. President, as a member of the Judiciary Committee, that we never discussed at all. It is not a matter we spent any time at all discussing as we moved forward with legislation which ultimately cleared that committee and came to the floor — legislation which I thought was not good legislation and which I opposed, and so did the Senator from Texas, who just relinquished the Chair. We didn't discuss the financial impact of the legislation before us.

Immigration target: Memorial Day - WASHINGTON -- Majority Leader Bill Frist intends to seek Senate passage of immigration legislation by Memorial Day, hoping to revive a bill that tightens border security and gives millions of illegal immigrants a chance at citizenship, Republican leadership aides said Friday.

In a gesture to conservative critics of the measure, Frist and other Republicans also intend to seek about $2 billion in immediate additional spending for border protection.

The aides said the money would allow for training of Border Patrol agents, construction of detention facilities for immigrants caught entering the country illegally, the purchase of helicopters and surveillance aircraft and construction of a fence in high-traffic areas.

The aides spoke on condition of anonymity, saying they did not want to preempt a formal announcement.

"The goal here is to make sure that the Senate does act on this problem," one of the aides said.

Frist's decision signals a determination by Republicans to press toward passage of election-year legislation. The issue has triggered large, peaceful street protests by immigrants' rights supporters as well as internal disputes in both parties and partisan bickering.

A sweeping immigration bill was gridlocked as lawmakers left town two weeks ago after Frist and Senate Democratic leader Harry Reid of Nevada failed to agree on a procedure for voting on amendments sought by Republicans opposed to the bill. Supporters of the measure said at the time they had as many as 70 votes for the bill, and Reid drew criticism from at least one prominent group supporting the measure.

President Bush repeatedly has urged Congress to approve a bill that tightens border security at the same time it addresses the problem of the estimated 11 million men, women and children in the country illegally.

House Republicans have passed a bill that is limited to border security, but leaders have recently signaled they would be receptive to broader legislation.

Mexico may reverse its position

The measure at the center of the Senate stalemate would provide for stronger border security, regulate the future entry of foreign workers and create a complex new set of regulations for the estimated 11 million immigrants in the country illegally. Officials said an estimated 9 million of them, those who could show they had been in the United States for more than two years, would eventually become eligible for citizenship under the proposal.

Critics of the measure argue it amounts to amnesty, and they have worked in the last two weeks to undermine its support. But Bush has made it clear he wants legislation, and some Republicans hope they can send him a bill and gain credit with voters increasingly dissatisfied with Congress.

Meanwhile, a joint report by U.S. and Mexican immigration experts recommended Friday that Mexico bar its citizens from the most dangerous illegal border crossings, which runs counter to that nation's long-standing claim that it cannot stop citizens from massing at the border because the constitution guarantees freedom of movement.

But Assistant Foreign Relations Secretary Geronimo Gutierrez said in Mexico City that his country was willing to consider the idea that "restricted access zones should be established in dangerous areas."

Arrests in Chicago

The attempt to add $2 billion to border security spending is expected next week, when the Senate is to debate legislation providing funding for the war in Iraq and relief from last fall's hurricanes.

Some critics of the bill have argued that it makes little sense to pass legislation affecting the current population of illegal immigrants as long as the border remains porous.

Homeland Security Secretary Michael Chertoff told reporters he intends to increase enforcement efforts at places of employment.

Federal agents Wednesday arrested seven current and former managers of IFCO Systems, a manufacturer of crates and pallets, on criminal charges, and more than 1,100 people were arrested on administrative immigration charges at more than 40 IFCO sites in the United States, including in Chicago.

"Legal Versus Illegal Immigrants. In this report we concentrate on the results for immigrant headed-households overall. However, in several parts of the study we further divide immigrant-headed households based on the immigration status of the household head. These divisions include separate analysis of households headed by all legal immigrants, those headed by refugees, those headed by legal non-refugees, and those headed by illegal aliens. These divisions are helpful in understanding immigrant welfare use because eligibility for programs is often linked to immigration status. In fact, the immigrant provisions of welfare reform only applied to legal immigrants who were not yet citizens. Illegal aliens were supposed to be ineligible for welfare programs even prior to welfare reform. As discussed above, all children born to immigrants in the United States, including those born to illegal aliens, are automatically American citizens, and thus have the same welfare eligibility as any other citizen. Thus it is important to see how welfare use varies for different types of immigrant households. For example, it is sometimes suggested that only refugees make extensive use of the welfare system. Other observers point to illegal aliens as the primary problem. By dividing immigrant households based on immigration status we hope to answer some of these questions.

Determining Immigration Status. The CPS does not ask the foreign-born if they are legal residents of the United States. However, the INS, Census Bureau, and others have used socio-demographic characteristics in the data to estimate the size of the illegal population by picking out respondents who have a high probability of being in the country illegally. To determine who is legal and illegal in the survey, this report uses citizenship status, year of arrival in the United States, age, country of birth, educational attainment, sex, welfare receipt, and marital status. We estimate that in the March 2002 CPS there were 7.9 million illegal aliens. (This estimate only includes illegal aliens captured by the March CPS, not those missed by the survey.) This estimate is similar to those prepared by the Census Bureau, the Immigration and Nationalization Service (INS), and the Urban Institute9. It should be obvious that there is no definitive means of determining whether a respondent in the survey is an illegal alien. Even estimates prepared by government agencies are at best highly educated guesses about illegal immigration. Different assumptions will, of course, lead to somewhat different results. In fact, the Census Bureau and the INS have arrived at somewhat different estimates for the overall size of the illegal population. Despite the inherent problems in identifying illegal aliens, the analysis of illegal aliens in this study is consistent with previous research and should provide a good idea of the difference between households based on the immigration status of the household head. "

Having said this, one can understand how the North American SuperCorridor Coalition, Inc. (NASCO) subsequently sprung up and declared itself to be "NAFTA's trade supercorridor" from Mexico to Canada. Note in the accompanying map from NASCO's web site that the supercorridor begins in Mexico and ends in Canada, with a U.S. route starting at Laredo, Texas and proceeding to Kansas City, MO. According to NASCO's web site,

"The NASCO Corridor encompasses Interstate Highways 35, 29 and 94, and the significant connectors to those highways in the United States, Canada and Mexico. The Corridor directly impacts the continental trade flow of North America. Membership includes public and private sector entities along the Corridor in Canada, the United States and Mexico."
