Suspended ssentence stuns some jurors in rape case.

PAWNEE - Members of a Pawnee County jury are upset a judge suspended sentence to a man convicted of raping a 13-year-old.

The Jury had recommended a 30-year prison sentence.

One upset juror drove to the Pawnee County Courthouse and returned a check for $167.90 he received for serving on the jury.

"They didn't know what to do with it," said Bruce Funkhouser.

"Justice was not served by this at all," Funkhouser said.

The Supreme Court in U.S. v. Booker, relying on Apprendi v. New Jersey and Blakey v. Washington, struck down the mandatory requirements of the Federal Sentencing Guidelines. They severed the unconstitutional parts from the rest of the guidelines and specifically did not strike down the Guidelines themselves.
The first cases deal with state sentencing guidelines. These decisions apply to the states and the Federal government.

I don't know -- I am utterly convinced that some of these judges that give pers light sentences are "fellow travelers."

It just makes honest people criminals for righting a wrong.I have way to many grand children to have to worry about his type moving next door.I teach them all from a very young age,that if they were approached by anyone acting'funny'to come to me right away.We have a local Wal Mart here where a few people just sit in their cars all day watching people go in and out.One man just got busted for performing a sex act on himself in the parking lot.I wish I was making this stuff up.Normal people dont do those sort of things.

The rapist was 38, the girl 13. Appears to be a jury trial and guilty verdict for rape - not the statutory kind.

The story alludes to a witness that wasn't allowed to testify. Also a lawyer - not connected to the case, who alludes to a bad verdict. Hadn't heard about this till this mornings paper arrived.

That said, there is always the possibility that the full story isn't what the article reported. Stay tuned ...

that't the truth.....but remember, the judges belong to the "priviledged" class and don't have to mingle with the commoners....

Yes I'm the jurist and I did post this topic a few days back but it was pulled because I didn't link to the story properly.....sorry about that.......There is no doubt in the minds of any of the jurists as to this creeps guilt.....This young girl was looking for help and direction in her life so she went to a Church Youth Group and this pervert tells her the Lord sent him there to help her......Later he tells her the Lord told him it was ok for them to have sex because later onthey would be in ministry together......He had the girl, her mom, and sister at his home in Pawnee...They knew something was not right and made attempts to leave and once again Mr. Pervert tells them that the Lord has showed him they will be killed in an auto accident if the leave.......There are many more points that I could make but it actually makes me ill to try and express my thoughts on all this properly.....and yes I did return my juror money...if this is Pawnee County justice I want no part of it.....

Seems like every day there's another article about some sick subhuman child molesting scum who gets zero punishment, or maybe is told to stand in the corner for an hour.

If my daughter was abused, I'd kill the a**hole.

Returning the check cost you $167.90 but at least you got something for your money. We might not have heard about this case otherwise. Maybe media attention and public outrage will prevent the judge from making a similar decision in the future. And if Gregory Lynn Bryant's name becomes well known, people will become wary of him and it might even prevent another incident.

Oh I doubt if Bryant ever touches a child again because he was in jail for 4 months...looking at 30 years and he got away with little or nothing...Judge Sellers said he was powerless to grant a new trail unless the defense asked for it and they knew he would be convicted again in a new trail so they sure didn't want one.....Knowing that he knows he will now be watched like a hawk is of minor importance to me.....The fact that this courageous young girl was not rendered justice is what bothers me....If we don't protect the children, the elderly, the handicapped and disabled what kind of society have we become?

Glad you checked in, OklaRancher. Hearing from someone who was there and confirms the story is true as reported gives me a little confidence in the news media. Why in the world did the judge suspend the sentence? Any thoughts or theories?

what kind of society have we become? That is a question we should all ponder.

Judge's sentencing decision in child rape case irks jurors

PAWNEE, Okla. Jurors who convicted a man of raping a 13-year-old girl he met at a church are upset that a Pawnee County judge has significantly reduced the man's sentence.

The jury found 38-year-old Gregory Lynn Bryant guilty in November of raping the girl and recommended he serve a 30-year prison sentence.

But on March 10, District Judge Jefferson Sellers suspended Bryant's sentence and instead placed him on probation.

Bryant was released March 10 from the Pawnee County Jail. He has told authorities he plans to move to Stillwater.

Sellers says he erred in not granting a motion by Bryant's attorneys for a trial continuance. The defense wanted the nurse who performed the sexual-assault exam on the girl to testify.

Several jurors are expressing anger about the judge's decision. One of them, Otis Ryan of Pawnee, calls the suspended sentence "a bunch of crud."

I'm sure Judge Sellers decision is based on the lack of physical evidence and no abrasions or tearing of the girl.....Was not conventional sex.......However he had the girl shower immediately...she didn't report it for 3 days or more so he had ample time to wash his sheets etc. We heard the nurses testimony and the defense tried to make a big deal of the girl being in a good mood and happy at the exam.....Jeez shes 13 years old, been thru hell...I'm sure her emotions swung back and forth many times a day.....Had the nurse been there to testify in person the verdict would have been the same.....I may call the Judge in a few days as he stated the jurors can call him if they want to.
