PAWNEE - Members of a Pawnee County jury are upset a judge suspended sentence to a man convicted of raping a 13-year-old.
The Jury had recommended a 30-year prison sentence.
One upset juror drove to the Pawnee County Courthouse and returned a check for $167.90 he received for serving on the jury.
"They didn't know what to do with it," said Bruce Funkhouser.
"Justice was not served by this at all," Funkhouser said.

The USSC rulings regarding sentencing guidelines doesn't effect this case, or any State Court, at all. The USSC dealt with the Federal Sentencing Guideles which applied only to defendants convicted and to be sentenced in Federal Court for a violation of Federal Criminal laws. This was a State Court case and as such the Federal Sentencing guidelines do not apply at all. Rather, the OK state sentencing statutes would control on this.

The girl's mom was in drug rehab and her daughter stayed with this guy, she asked him if something was going on and he told her she was just a druggie. Anyway the Judge made some remark about the defendant should have been able to call a nurse as a defense witness, figures the case will be remanded back to him so he can't say anymore.
So I ain't got nothin' to say.

Another one. It doesn't say whether the victim was a girl or boy.
The problem is exacerbated by liberals, but the lawyer code of laundering any and all acts of disgrace is the problem. I think judges should not be lawyers, period.
A thread was posted about this a few days ago by someone who claimed to have been a juror on this case. He was very upset. At the time he didn't have any link to post and the thread eventually got pulled. He might have been a newbie too, I'm not sure on that. I wish I could ping him to this thread, don't remember the name.
Sure did, Federal guideline standards were struck down. What we are seeing here is a 'trickle down' effect. Judges don't have to go by legislative standards if they don't feel like it anymore.

NEXT DOOR??? Hell, no...the judge should have to take the perp INTO his house and have him up close and personal with his precious family. Then when the perp gets into trouble again---which he will- the judge gets to lose his job permanently and his bar license. Let him drive a bus or something. He doesn't belong being a judge.

I agree. This is a bad post.
That asked, and aside from the answers, considering the gross difference between what the jury recommended and the judge's actions, I'd say this is a judge that should be impeached, ASAP.
