The USSC rulings regarding sentencing guidelines doesn't effect this case, or any State Court, at all. The USSC dealt with the Federal Sentencing Guideles which applied only to defendants convicted and to be sentenced in Federal Court for a violation of Federal Criminal laws. This was a State Court case and as such the Federal Sentencing guidelines do not apply at all. Rather, the OK state sentencing statutes would control on this.

I would not say their sentencing statutes are OK at all...in fact, they need a lot of work. :)
