OCALA, Fla. -- A Florida judge said a plea deal for a Tampa teacher accused of having sex with a 14-year-old would "erode public confidence in" schools.
Marion County Circuit Judge Hale Stencil has rejected the plea deal for Debra Lafave, 25. The judge said the deal would undermine the credibility of the criminal justice system.
Prosecutors and the defense lawyer had urged the judge to accept the deal for the good of the boy. A psychiatrist told the judge the boy suffered extreme anxiety because of intense media coverage of the case and does not want to testify.
Lafave was charged in two counties where she's accused of having sex with the student.
A judge in Hillsborough County accepted a plea deal there in November and sentenced Lafave to three years of house arrest and seven years' probation. She pleaded guilty in November to two counts of lewd and lascivious battery for having sex with the boy in a classroom and her home.
the charges will be dropped now - the plea deal was something at least, now she walks. she walks right over to Playboy.
So this judge should just throw in the towel on trying to keep up the integrity of the court?
Fine. Then say it was a vasectomized male teacher that women would consider stunningly handsome - in a Clooney/Pitt category of appeal.
What if it was your 14 year old daughter?

Let's get real here. First of all, this case is fairly unusual (I assume).
I don't know if you have sons, but in all honesty...
...tell us how, when they were (or will be) 14, you will call them aside and somberly instruct them, "Son, if a drop-dead gorgeous married woman ever hits on you, here is what you should do..." ??
Any more subtle alternative is literally impossible, and probably equally ineffective except for the abnormal.
Ever been in a high school locker room in the late 70's? There would have been major bragging going on, believe me.
This is the same justice system that rewards political hacks with judgeships without regard to their courtroom experience, ethics, legal knowledge, or temprement.

And what if said daughter had a very high IQ and was on the pill and practiced safe sex.
Personaly, girls being more mature emotionally are better candidates for this kind of stuff.

You are suggesting that she probably has AIDS either because she is married, or from her presumed "other boy victims".
That is totally a normal adult thought.

Agreed. In spite of whatever his hormonal state was, she committed a felony .. period, end of story.
They can't prosocute because his mom doesn't want him to testify (I'm pretty cetrain he's had all the spotlight from this he can stand) .. so the perp dodges jail time.
It's my belief that there shouldn't be any difference in outcome whether it's female perp / male victim of the other way around.
The kid may have willingly jumped on it but the perp knew it was a felony.
Instead, the judge save the "Integrity" of the judicial system, but since the family doesn't want the boy to testify, the charges will be dropped and for all intents and purposes the crime will have never been committed.

No, but I would be a lot more okay with it than if a teacher impregnated my 14 year old daughter. You don't see a difference?

I completely understand this, and for society to function and to keep from getting killed, your expectations of your son are spot on, but the moral responsiblilty lies with the married person. The single person has made no promises or committments.
Thou shalt not commit adultery. Thou shalt not covet thy neighbors' wife.
This boy is not a 'victim'. He was not 'victimized'.
That's the difference. For a girl, she would regret for the rest of her life having had a fling with a teacher.
Not so for the boy in this case.
