Conservatives long have complained about judicial agendas. Their new U.S. Supreme Court has practically trumpeted its first priority: a crusade to roll back abortion rights.
On Justice Samuel Alito's first day on the bench, the court announced it would hear a case on the constitutionality of a federal ban on so-called partial-birth abortions. Coincidence? Not likely.
Previous rulings have made it clear the government cannot ban women from seeking an abortion when their health is at risk. Lower courts already have rejected the 2003 federal ban repeatedly. With Alito aboard, a majority of the justices want to think again, or perhaps just slam the gavel down for a predetermined outcome enacting a partial theft of women's rights.
With that kind of readiness to rewrite the law on the high court, the South Dakota Legislature's wild rush toward a nearly sweeping ban on abortion comes into perspective. If the justices begin nibbling away at Roe v. Wade on partial birth, a South Dakota ban might provide a case that would let them wipe out the right to choice.
On Thursday, Sen. John Kerry sent out an appeal asking for Democratic campaign donations "if you want to prevent the next Samuel Alito from being confirmed to the Supreme Court." Next? It's beginning to look like the Democrats want to be paid to shut the barn door after the justices have mounted their horses for a well-planned, dangerous ride.

In Seattle if you can only get mid fifties to keeping Roe the law of the land, you gotta know everywhere else it's probably 55-45 the other way.
