Senator Feinstein to Vote No on Cloture for the Nomination of Judge Samuel Alito to be an Associate Justice of the Supreme Court

Washington, DC – U.S. Senator Dianne Feinstein (D-Calif.) today announced that she will vote no on cloture regarding the nomination of Judge Samuel A. Alito, Jr. to be an Associate Justice of the Supreme Court.

“Based on a very long and thoughtful analysis of the record and transcript, which I tried to indicate in my floor statement yesterday, I’ve decided that I will vote no on cloture.”

I agree. Especially with this scenario. We're in a win/win either way. They filibuster, our base comes out in Nov. They don't filibuster, THEIR base stays home. ;)

As they should be. They are in a no win position! LMAO! Either way, they are screwed. I figure they're going to try some stunt like they did with the closed session again. I really hope they keep it up. They're just assuring our base will come out strong in Nov.

There is a third scenario which is very likely - the democrats filibuster and the republican senators do not go nuclear.

In this scenario the republican base stays home in November out of disgust and Bush is severely weakened. This would be a dream come true to the democrats.

If the democratic leadership senses that the "constitutional option" would not be passed by the Republican senators then they are very likely to filibuster.

There are a lot of Conservative counties in CA. Several metro/urban areas are Lib-infested but a lot of the landowners and entrepreneurs in this vast state have a clue.

Three counties turned Conservative would move CA electoral votes to Republicans.

Must....work....harder....

I don't doubt that, but California is still a very liberal state - at least socially. A fiscal conservative/social moderate may have chance if they have a very strong name recognition (like Arnold) or a really cute asian or hispanic woman but otherwise I don't see any politicians losing any statewide elections simply because they are too liberal.

You are much closer to the action in California that I am, however. Do you know of any credible opponents for Feinstein?

The republican senators have been very consistent in their spinelessness. The democratic senators act like the senate is a barroom brawl while the republican senators act like it is a country club.

Going nuclear is not a trivial vote. This vote will be portrayed as the republicans trying to overturn democracy and the first step of turning Bush into a lifetime dictator. Many republican senators will be terrified of such a vote.

I feel that the chances of the senate going nuclear are very remote. When have they not backed down?

Indeed. With over 50 republican votes for Alito's confirmation virtually assured, a democratic vote for cloture is the same a "yes" vote for confirmation. A democratic "No" vote for confirmation would at best be symbolic but completely impotent.

And what that means is that red state dems are really in a quandry. ;)

If they support a filibuster, they could likely lose their seats in the general. I can't think of a better way for the pubs to pick up some seats than to use the Dem filibuster as a way to get the base out to vote.

Also, as someone has said before, why hasn't our side starting to run ads about O'Connor wanting to retire and the big bad mean Dems are stopping her from doing so?

Actually, I hate her for the way she resigned. We wouldn't be in this pickle if Bush could recess appoint like others have done in the past!

Again, only if the republicans don't go nuclear and the chances of the republicans actually going nuclear are lower than the democrats filibustering.

The scenarios...

No filibuster, Alito confirmed
- republican victory
- democratic base angry and disheartened
- republican base unchanged or maybe complacent

filibuster, GOP goes nuclear
- republican victory
- democratic based feels threatened and gets more energized
- republican base happy but maybe complacent in Nov

filibuster, GOP does NOT go nuclear
- major democrat victory
- major defeat for Bush
- democratic base happy but maybe complacent in Nov
- republican base seriously depressed and loses senate in 2006

They are harrassing all the Democrat Senators to filibuster. That is all they care about. They are not satisfied by just a NO vote. They hate Bush so much they just don't care.

The lefts latest ''innovative'' stunt to oppose Bush , is that when Bush is giving his SOTU speech they are planning to march on the capitol and blow horns in their cars to ''drown'' it out......I know this sounds nuts but thats how ridiculous and low these people have sunk. .....Unlike some , I am not surprised at all by this desperate, fake, filibuster business.

Or the democRats do a token filibuster that lasts up to the brink of the "Nuclear Option" -- then they cave voting for cloture.

This has nothing to do with hating Bush - they oppose Alito on ideological grounds. A confirmation "no" vote by a democratic senator is meaningless since the republicans can confirm Alito without one single democratic vote.

Of course they want a "no" vote on cloture since that is in reality the only way that they can stop this nomination. If Alito gets a confirmation vote then it is too late for them.

What quandary? If every senator were to vote for cloture (100%), then the radical nutcases on the far left would be slapped down very effectively.
