Senator Feinstein to Vote No on Cloture for the Nomination of Judge Samuel Alito to be an Associate Justice of the Supreme Court
Washington, DC U.S. Senator Dianne Feinstein (D-Calif.) today announced that she will vote no on cloture regarding the nomination of Judge Samuel A. Alito, Jr. to be an Associate Justice of the Supreme Court.
Based on a very long and thoughtful analysis of the record and transcript, which I tried to indicate in my floor statement yesterday, Ive decided that I will vote no on cloture.
She and Collins often "split" on these sorts of votes. I think Snowe can afford to vote against the nominee, but I also think that the prevailing rhetoric by other pro-abortion-on-demand Republicans (Specter for example) gives her some cover if she wants to vote to confirm.
She's an odd duck, for sure. Responds to inquiries (I get letters from her, following my questions or urgings), but as often as not, the response shows that either she didn't "get" the question (could be her staff screwing up), or she doesn't want to answer it.

I wouldn't be shocked if Kean Jr. won the special election, but then again, his failure, i.e. a repeat of his only major run for office prior to this, is not a wholly implausible scenario.
That state is a fetid blue swamp, unfortunately, almost as bad-if not worse-than mine.
If a candidate as bumbling, as idiotic, as unappealing-not to mention, radical-as Jon Corzine can cruise to victory then a Menendez victory shouldn't be ruled out prematurely.

Abstaining from the cloture vote is the same as voting "no" for cloture (yes for filibuster). IIRC, It takes 60 votes for cloture to occur - neither "no" votes nor abstain votes count toward the 60 so they end up being the same thing.
I am not sure if the number of votes for cloture is reduced if a voters abstains however.
Prediction:
Next week the DUmmies will be crying like they did after the election, when they were SO SURE because the exit polls were saying that Kerry would win. It's going to be " what happened, we were winning them over, blah, blah, blah... I spent all that money on phone calls and long distance (last time campaign contributions)... CRY, CRY, CRY... I'm never gonna trust them again... blah, blah, blah.
That's what makes this SO FUNNY !!!
To be fair, Fienstein did run on a pro-abortion platform and her state is very much pro-abortion.
We may disagree with her stance, but it is the stance that she ran on. If only republicans would be so true to the issues that they campaign on (tax reform, spending cuts, cutting government, etc).

Now I'm hearing Reid is for filibuster. This is getting acute.
A politician that would base their vote on emails or phone calls would be a fool. It is totally unscientific representation of how the people it that politician's state really feel.
Phone calls from huge mega-donors or lobbyists will hold some sway, but they call the senators directly.

This would be suicide for the democrats. Frist and the republican senators would be forced to go nuclear or they would voted out of office at the earliest possible date.
Hopefully, the nuclear option would include all judicial appointees and not just those for the supreme court. If that occurred, Bush could get all of his judicial nominees approved at light speed before the 2006 elections.

Not all may vote for Alito.
3 Dems will vote for Alito. Johnson, Byrd and Nelson.
2 Dems say they will vote NO on a Confirmation, YES on Cloture. Landreiu and Salazar.
55 + 5 = 60 = Game, Set, Match. Add Pryor & Conrad to the list = 62 min.

If those votes become shaky then I believe the rest of the democrats will become emboldened and anounce that they will vote against cloture.
Mojor Garrett just reported that Cindy Sheehan said from Caracas Venezuela today that if Fienstien didnt support the filibuster, Sheehan wouls challenge her seat in the upcoming election! L0L
Garrett then reported with a straight face that Fienstien says Cindys comment had nothing to do with her change in position on the filibuster L0L

Just heard on Fox News that Cindy Sheehan, speaking from Venezuela, said she would run against Feinstein for Senate if she didn't vote to filibuster.
Bet Dianne's shaking in her boots over that one.
