Lawyer: Authorities were told student's gun was fake

LONGWOOD, Florida (CNN) -- The father and brother of a teenager shot at school Friday while brandishing a pellet gun told authorities before an officer opened fire that Christopher Penley's gun was not real, the family's attorney said Saturday.

The eighth-grader is clinically brain dead and being kept on life support to harvest his organs, attorney Mark Nation said.

When Ralph Penley arrived at the school Friday to help police and school officials defuse the situation, he wasn't allowed inside, Nation said.

Nation said Ralph Penley was "angry" because he had spoken to police before he arrived at the school and told them Christopher did not have a real gun. Christopher's younger brother told school officials the same thing, Nation said.

Well you don't point at the police anything that looks like a gun and not expect to be shot in return.

It is a shame, but not unexpected.

Every day for 19 years I woke up saying "Today is the day I make a sarcastic remark and leave off the sarcasm tag!"

I am seriesly stuned by the number of people who don't get sarcasm without the sarcasm tag....

My guess is that this Cop is feeling very devastated right now. All the trianing in the world can't make up for finding out, After the Fact, that you could have chose differently.

It's tragic that this Cops career just may be shattered over doing his job as he is supposed to.

It's tragic that a 15 year old teenager (not a child) died as a result of his own behavior.

It's tragic that the parents didn't take stronger action to prevent this behavior.

It's ridiculous and ludicrous that some feel the Cop is a murderer.

Was the cop who was involved in the shooting told that the student's gun was "fake"? I mean, before the fact?

I'm guessing not.

I'm also guessing that it will be determined a "Good Shoot".

I have been fooled a number of times...and thats what makes Freeping so dang much fun, besides Freepers being the best bunch of people to communicate with !!!!! Are you willing to stand up and let me shoot you with my pellet gun? Pellet guns can be every bit as deadly at close range as a 22 cal. bullet.

Pellet guns also look like real guns. There seems to be alot we don't know here, it's unfortunate. Once police are confronted by a person holding what appears to be a pistol they have little choice if the person does not obey police orders. Too bad.

"This was a small town. These small town cops receive training about gun battles, terrorists, etc. They almost never get a chance to pull out their gun and fire it. So when their chance finally does arrive, they tend to be trigger happy."

Most SWAT team officers are ex-mil. They have to train every week and qualify monthly as shooters.

A pellet gun is not a "fake" gun, and is not a toy. It's not a .44 Magnum, but that is beside the point: it is a weapon.
The kids certainly wasn't brandishing it as a "toy", wasn't "playing" with it. Definitely "damned if you do, damned if you don't" for the cops.

In my time the police were not called first. Shall we all bow down to the almighty Police state? I think not. Unless you were the candy-ass that went crying to momma when they got hit with a bb. Appraisal of the situation is important.
