Day 4: Hearing Resumes

This morning, Senators will question Judge Alito during a third round. They will then go into a closed session, to review the FBI background investigation on the Supreme Court nominee. Outside witnesses may be called to testify this afternoon, as well as the American Bar Association, to discuss its recommendations.

11:52 Feingold wants to return to questions about Presidential power, and asks if the President can violate a constitutional statute if in bans an inherent constitutional power of the President. Alito says that the constitution trumps a statute, but the situation that Feingold describes fits precisely into Jackson's framework and is the area where the President's powers are at their lowest ebb, and to decide if the President could violate the statute would require an examination of the specific facts.

Article 1 Section 9 Clause 2 gives him incredible powers which ARE constitutional.

So far the stupidest question I've heard today was Jeffrey Tobin to Ed Gillespie on why the judge doesn't just say I'll vote for Roe V Wade to against Roe V Wade like politicians do when they run for office -- Ed Gillespie had to give Jeffrey Tobin a lesson on the difference between politics and running for office and Supreme Court Justice who is supposed to be balanced and impartial and that he's not running for office...

I sent an email to Wolf Blitzer and asked where Tobin got his license, because he needs to go back to school.

Feingold wants to go after the President. He knows that Alito will be confirmed. He is reflecting how thin skinned the Dems are in this infantile display to argue that W is just like the most useless man in America and her husband.

I think we need to start a grass roots campaign to have Ted Kennedy named as a Supreme Court Justice so he can have the "honor" of sitting before his peers and the world can listen to a replay of his "stellar" history. A few of the unforgettable moments would be his dismissal from Harvard for cheating and a thorough investigation into the death of Mary Jo, for starters. No doubt there are other memorable events in his life.

Sealed bottles of water would be the only allowed refreshment to insure his safety.

Well, I am not the brightest bulb in the light, but I'm fairly certain that the Constitution isn't contradictory and is pretty specific when the framers wanted to be specific. I think roles are probably clear. The Dems just don't like them.
