Is it really over? Schumer had his big moment in history and didn't land a punch? I cant believe it! I had to stop watching after hearing DiFi's monotonous spiel for the 88 millionth time.

I'm worried about the Lindsay questions. Of course Alito can not answer them, but he did look a little hesitant and makes me worry about exactly where he stands.

I'm not so concerned about where he stands, I trust him with judicial power. The problem I had, in general, is that he came off as not having given the subject deep thought.

To be fair, I missed the substance of his answers, but noted the "quiet" following Graham's rapid fire assertions and questions.

I wonder where he stands on the declaration of war. Is the president sitting on a time bomb.

I think that issue is more between Congress and the President than between the President and the Courts. Our government has three parts that operate togather (in some ways), and against each other (in other ways). That's not an unhealthy arrangement, and is something that makes our system so different, if not responsive.

And, why does no one mention that we have enemies in America and there is always the chance that those enemies have progressed into our government?

It's a delicate subject - but for waht it's worth, most of the enmies penetrate administration organs such as CIA, FBI, and military.

But as for the Alito confirmation, as much as Graham's questioning was uncomforamtble for me to watch, I don't hisnk it has any impact on the confirmation. I will downgrade my previous "A- /85 or better" on Alito's performance to a "B+ / 80 or better" - he's doing GREAT, IMO, and he will meke a fine replacement for SDO.

To abide or adhere to decided cases. It is a general maxim that when a point has been settled by decision, it forms a precedent which is not afterwards to be departed from. The doctrine of stare decisis is not always to be relied upon, for the courts find it necessary to overrule cases which have been hastily decided, or contrary to principle. Many hundreds of such overruled cases may be found in the American and English books of reports.

An appeal court's panel is "bound by decisions of prior panels unless an en banc decision, Supreme Court decision, or subsequent legislation undermines those decisions." United States v. Washington, 872 F.2d 874, 880 (9th Cir. 1989).

Fox & Friends this morning said that they called every one of the Dems on the committee and asked them to come on their show this morning. NOT ONE WOULD.

They said that they would continue to call them this week, but as for this morning Senator Cornyn went on alone.
