MARYVILLE, Tenn. A mother charged in the shooting death of a man she said raped her young daughter was sentenced to four years in prison today.
Authorities say Kimberly Cunningham must serve nearly a third of the sentence before being eligible for parole, The Knoxville News Sentinel reports.
Her attorney Bruce Poston told Blount County Circuit Court Judge D. Kelly Thomas that he would appeal the sentence.
In October Cunningham was found guilty of voluntary manslaughter in the death of Coy Hundley, her daughter's uncle.
Cunningham was tried on a charge of first-degree murder in April in the case, but the jury acquitted her of that charge and deadlocked on all lesser charges.
Cunningham has served about two months in jail since the October 7th 2003 killing and Poston said that would be deducted from her sentence.

You really seem to have a dog in this hunt.
Makes me curious the angle that from which you're approaching all this.
I can't tell if you're naive' or just simply cold.
Thanks sweetie,
Just doing some late night catch up work.
Hang in there. Believe me, in the parallel universe I seem to live in, there are lots and lots of survivors. :)
And I'll stand by my 1 in 3. (Geez, some weeks it seems like 1 in 2 ;))
That number is wildly out of line with data from the Bureau of Justice Statistics. Please post a link to your source.
Why did you want this man silenced before he could answer the charges to the police and if necessary, court?
Taking a life is a big deal to me. I'm sorry that your heart is cold when it comes to taking a human life just on a whim.
Most cases do not get reported sad to say. The Justice Stats come from reported cases.
No problem I got a laugh. The Free Mail will shine some light on it all :>} I am looking at all sides of it.
See: "Jury Nullification"
Like I said,
I'm the wrong person to ask (remember, you asked me the question, I gave an honest answer)....
I wouldn't serve on a jury in a molestation case, I'm biased and I know it. I do feel some pity for the molested kids I've seen grow up into molestors who are now wards of the state because they can't control their impulses. They are damaged.
If someone screams in my arms that she wants her molester dead....I'll agree that he deserves to die. Believe me, cutting off a kids legs or blinding them would do less damage to their souls. You're crippled in ways you can't even imagine...this isn't a snark at you, but you don't seem to get where we're coming from on this.
I'm damaged, I know it. I'm putting my life back together bit by bit. But you asked a question, I gave an honest answer. I am the product of systematic, hyper-religious, super-self-righteous molestation, incest and abuse...the worst kind of evil there is. Once it has destroyed your innocence, life does take on a different cast.
Oh yeah, read my tagline hun ;)
No, they don't. They come from anonymous telephone interviews.
"The National Crime Victimization Survey (NCVS) Ongoing since 1972, this survey of households interviews about 75,000 persons age 12 and older in 42,000 households twice each year about their victimizations from crime."

Then your parents simply don't love you. Sorry to be so blunt, but it's true, and they are unworthy of any loyalty you might have toward them.
..
Exactly. No one talks about it. You try to forget and put it behind you...until about the 3rd suicide attempt, or the 23 hour crying jag for no reason leaves you stunned, or you realize that you have chunks of your childhood you don't remember.
Anyhow, everyone I've know in my life whose been molested, only a tiny percentage has really came done anything about it...or even talked about it....most keep it as a quite secret.
It comes out in support groups, or during some kind of crisis or just after 3 Margaritas on a girls night out when you get all weepy. :)
I also have a theory. Like the boy in the Sixth Sense who could see dead people, I do honestly believe that molested kids literally pass onto a different plain of existence and they see the world through different, dark eyes. And like recognizes like. That's probably why I knew of so many horror stories growing up while innocent others saw the world as marshmallow cream.
I saw what others could not see, I could see others like me also.
I've heard said to me that before especially in relation with battered wives as well.
So how do I post a link to a live radio program?
Do you suppose that just *maybe* -those- numbers come from the actual women the support group deals with rather than some BOJ stats based solely on women who actually report to law enforcement?
They believe that they love me perfectly.
[I believe they loved the status quo more]
Blunt's fine.
I suspected as such a very long time ago.
Sadly, I take the "honor thy mother and father" thing too seriously.
Hubby constantly tells me that respect and honor are earned, not automtically awarded.
I'm learning....:)
Hence the tag "Cursed With Second Sight".
In the true and original meaning, that has nothing to do with predicting things.
It's seeing the reality behind the facade and came from the Celtic belief that 'the Good Folk' could assume the shape of anything or anyone they pleased.
A horse may not be a horse, a tree not a tree.
It's the hidden truth behind the mask.
It is indeed a dark sight.
I wonder about that, too.
The radio station probably has a website, and if it is possible to listen live, there should be a link somewhere. Just copy that page URL from your address bar to the FR post. If you don't feel comfortable doing that, post the station's call letters within the next few minutes and I'll do it.

The DOJ stats come from telephone interviews of about 75,000 people. The stats have nothing to do with reports to law enforcement. See my post #149.

I could find no program archive.
If it's that important to you to prove me wrong, call them and ask the station manager about the segment they ran sometime during the last couple of weeks about sexual abuse.
I wish I could narrow down the timeframe for you but one particular radio runs that station 24/7 in one particular room and I'm in and out of it at various times during the course of the day.
I didn't know that I'd need to document the show for purposes of cross-examination so I did not make a note of the date or time.
"The DOJ stats come from telephone interviews of about 75,000 people."
I never called them.
I never even heard of them.
How those stats be absolutely infallible if every abuse survivor isn't even aware they exist?
Have a nice night.
I can't find a "listen live" link or an archive either.

Whatever was said on the show you heard, it is just about certain to be less credible than the results of the Department of Justice studies. The sample size is huge, the polling is anonymous, and the sampling is done twice per year.
Wildly exaggerated rape statistics have long been used by feminists to falsely brand all men as likely rapists. Besides debasing men, such statistics needlessly terrify women, and poison male-female relationships.
I never called them. I never even heard of them. How those stats be absolutely infallible if every abuse survivor isn't even aware they exist?
No one claims that the DOJ statistics are infallible, but they are as good as such stats are likely to get. If you are going to quote statistics, at least get them from a reputable organization.
