I hope they are wrong, at least in certain respects, about the
Scalito nickname. I'm more of a
Thomas kind of guy myself. Maybe Judge Alito has read a few things by
Madison. Let's hope.
The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite. The former will be exercised principally on external objects, as war, peace, negotiation, and foreign commerce; with which last the power of taxation will, for the most part, be connected. The powers reserved to the several States will extend to all the objects which, in the ordinary course of affairs, concern the lives, liberties, and properties of the people, and the internal order, improvement, and prosperity of the State. The operations of the federal government will be most extensive and important in times of war and danger; those of the State governments, in times of peace and security. As the former periods will probably bear a small proportion to the latter, the State governments will here enjoy another advantage over the federal government. The more adequate, indeed, the federal powers may be rendered to the national defense, the less frequent will be those scenes of danger which might favor their ascendancy over the governments of the particular States. If the new Constitution be examined with accuracy and candor, it will be found that the change which it proposes consists much less in the addition of NEW POWERS to the Union, than in the invigoration of its ORIGINAL POWERS. The regulation of commerce, it is true, is a new power; but that seems to be an addition which few oppose, and from which no apprehensions are entertained.

GRAHAM: Alito, Luttig, all these people are solid conservatives, and if they're filibustered based on ideology and philosophy, that's setting aside an election and the filibuster will not stand. I think the majority of the GOP 7 would vote the same way as Senator Graham has indicated, if the DEMs side of the equation is so bold and dysfunctional as to refuse to vote on the nomination.

Why not? Alito's record doesn't sound any more conservative than Ruth B-G's is liberal.

After the failed USSR coup in 1991, Yeltsin said it had been excellent, because, "now, at last, we know who is who".
We cannot win the public war for the Court until we decipher, and win, the secret war for the Senate.
Right now, we do not know how many Republican senators who are verbally committed to constitutional judges will turn away from being the 51st vote.
We do not know, in Yeltsin's words, "who is who".
But we're about to find out.

Has it been mentioned that Alito lives and works in Specters backyard, who will be hard-pressed to do anything but help his local guy.That logic is pretty out there. Alito's from New Jersey, Specter's a Pennsylvanian. One of them is pro-life, the other is not. Aren't you feeling the close connection?

Let's see, he graduated with a BA from Princeton and a JD from Yale. That is a definite plus for Buckley and the National Review on Line pack. Makes it unlikely they will trash him, but the Democrats now that is just a different story. Most likely Kristol, Frum, Podorhetz, Limbaugh and Will can be counted on to follow NRO's lead.
Really quite simple. Avoid SMU and suck up to Yale for a start. Up with the Catholics down with the Evangelicals. Need a judge to read the simple, directly written Constitution now mandatory. Check with the pundits and the bloggers (especially John Fund and Peggy Noonan of the WSJ) who now determine the SCOTUS nominee. The President, after all, is just the sign off figure for TPTB. The RATS are going to have some fun with this one.
All those who wanted the "nuclear option" now have it. But has anyone thought we might lose. Nuclear war is painful--even the knuckle dragging, Neanderthals from the Red states know that.

BRING IT ON, KENNEDY! BRING IT ON, HILLARY! Let's have this fight already. The American people will agree with Alito - and Rehnquist - that fathers should have that right. But take the argument one step back - Alito and Rhenquist are saying that the people could decide this issue the other way, but need to get it by the legislature.

Specter doesn't need a pretense to hold this nomination if he concludes Alito is pro-life. Upholding Roe v Wade is one of Specter's litmus tests.
