Victoria Toensing is pointing out that Fitz didn't make his case for the espionage case .. just that Fitz thinks he can use this law

BOTTOM LINE:
1. No one was indicted for outing a covert CIA agent.
2. In all of Fitzgerald's filings to the District and Circuit courts, he refer's to Plame as a "purported" covert operative.
3. By his own statement, Fitzgerald's case is not about the war in Iraq.

He is going over the top with five counts but I cannot believe the people on here defending him for (alleged) lying to the FBI and GJ. Agreed, Mom - if the charges are true, then he will get what he deserves.
I hope for a vigorous discovery by his defense counsel and an acquittal on all charges.

There's the bottom line. He wants to be 'vindicated' before the public and if he make his charges stick, the people will be happy to pay for this travesty. He waits until the last hour of the last day to file five process charges with no underlying crime.
This ought to be a lesson to the next president, Democrat or Republican: enough with these lame-ass special prosecutors! Never call another one again!

Was Barry Richard the lawyer who defended President Bush in Bush v. Gore?

You have summed it up perfectly IMHO. The key is what Libby told the GJ and the FBI. I don't recall would have solved this problem. Better to say that then keep on talking.

"IF" Libby has committed a crime, and they prove it, then all bets are off. At this point, I think he's innocent.

I agree. While the action for a new Grand Jury has been called to continue this, I'm not sure it is official. If this WAS ALL secret, then it should have remained secret throughout the continuance.

Alleged is the key word.
Libby deserves due process and is basically innocent at the moment.
Looking forward to hear what his defense is.
My bet is the prosecutor is not in possession of a stained blue dress.

Now Fitzgerald attached to the indictment that Libby did not hear her name from reporters first which is cause enough to subpoena Wilson and Plame and question them whether they had ever talked to reporters about their positions. It doesn't have to be proved of what they talked about but just the possibility that they disclosed their own identity to reporters to give reasonable doubt to Libby's defense.

I REALLY like Barry Richard. Libby ought to think about hiring him. I'd hire David Boies too. He's an outstanding defense attorney.

Pardon me, but I'm a little confused. Fitzgerald kept saying that Libby is innocent until he is proven guilty. Then why does it feel as tho Libby has been tried, convicted and is on his way to 30 years in prison, plus owing more than a million in fines? Did I miss something? Wow! I'm glad I'm not the only one who noticed this!!!
