Fotz even lost it. I suppose he's been reading the news all along....looking for tidbits. The Grand Jury is probably "insane" by now and thank God can go home. Someone mentioned that the Prosecutor usually gets what he wants from the jury.

Haven't read all the posts yet so don't know if anyone touched on this, but is he actually charging Libby under the Espionage Act, which Fitzgerald said is vague?

Not being a lawyer has its limitations. If I hear correctly Fitzgerald asked the Grand Jury witnesses not to discuss their testimony. It has always been my understanding that witnesses can discuss what went on in the Grand Jury in respect to their testimony.

If I am not wrong in this, Fitzgerald is putting some barriers up that Libby's attorneys may have difficulty with--that is, finding which GJ witnesses to depose. An effort that could be construed as taking unfair advantage of a person open for indictment who cannot listen or speak to other grand jury witnesses because they have been muzzled by the prosecutor.

Just my thought. By the way, In my previous post I made a judgment favorable to Fitzgerald based on his psychological approach to the press conference. I, of course, have not passed judgment on the legal meritoriousness of his arguments.

Morphed into 2 issues neither should not get lost in the shuffle.

1. Charges against Libby. That has been played out & it is what it is. Unless someone wants to investigate the 3 reporters, then it is up to the lawyers.

2. Who sent Wilson, his lies, the involvement iof the CIA.
At this point, I believe that while I know this is a major event in Libby's life, THIS is the issue of most importance. (Especially in light of Wilson's lawyer's statement)

I believe the CIA may have taken the position that Plame's status is classified. This whole excercise is, IMO, a hit piece against the white house and the President.

From what I've read, she was still listed with the CIA as NOC (non-official cover, meaning that her cover -- such as it was -- was as a businesswoman), although since she may have been outed by Aldrich Ames in 1994(?), she hasn't actually worked undercover since then. Sloppy bookkeeping? And the relevant statute seems to refer only to someone who has actually worked undercover outside the United States in the preceeding five years. Which she hadn't.
