That is a separate case. That case is still active, with Fitzgerald having appealed a Disctict Court opinion that the NYT and Miller didn't have to reveal their telephone logs, etc.

I assume you have the skinny on the fact that (getting her testimony re: tip off leak) is a pending case, still. There is a District court opinion that has been appealed, as of May.
