Opposing lawyers share thoughts on Schiavo case
Palm Beach Daily News ^ | October 1, 2005 | Michele Dargan

The only issue that David Gibbs can ever remember Jesse Jackson and Rush Limbaugh agreeing on was the fact that Terri Schiavo should remain alive.

...

Gibbs called removing Schiavo's feeding tube "barbaric and uncivilized." Florida law does not allow the starvation of animals and the constitution does not allow the starvation of convicted murderers, he said.

...

Felos said faith-based organizations, religious leaders, priests and rabbis distorted the facts in the Schiavo case.

Back in the day, polls indicated that Americans felt that the country was headed in the right direction. How times have changed in two short years. Look at this lovely photo.

I wish Gibbs and all of us would point out to all that the Autopsy shwed that Terri's Heart was undamaged and quite healthy pointing strongly to oxygen deprivation to the brain by other means.

Indeed and Terri was not terminally ill. Why was she subjected to end of life choices as they call them when she wasn't at the end of her life until they took away her nutrition and water? She wasn't PVS either. Terri was supposed to have inalienable rights. What the heck happened?

FLORIDA CONSTITUTION, ARTICLE 1, SECTION 2. Basic rights.--All natural persons, female and male alike, are equal before the law and have inalienable rights, among which are the right to enjoy and defend life and liberty, to pursue happiness, to be rewarded for industry, and to acquire, possess and protect property; except that the ownership, inheritance, disposition and possession of real property by aliens ineligible for citizenship may be regulated or prohibited by law. No person shall be deprived of any right because of race, religion, national origin, or physical disability.

Everyone should reread and memorize at least the last sentence if not the whole of this section of the Florida Constitution as you have posted FV. Terri was murdered in a most horrific way for being physically disabled. Her Autopsy strongly indicates she was choked back in 1990 causing the brain to be denied the blood it so desperately requires.Hopefully the Truth will be revealed and him or those who are guilty will be face the Justice they so deserve. God Bless Terri.

let's celebrate that Terri brought millions of strangers together. How did she do that? The meek shall inherit the earth.

Yes.

Hello, all. I have been silently reading throughout these boards for many months, but only today have decided to post. And the reason I do so is to ask a question. My question is completely sincere, and I hope you will all consider it in the spirit in which it is asked.

From everything I have read about Mrs. Schiavo (since I did not know her I do not feel comfortable calling her by her first name), I believe that she was a sensitive and shy young lady. I am haunted by the idea that as such, she would have been appalled by the pictures and videos of herself, in her debilitated condition, that have become so ubiquitous. Where her parents and some of her supporters see a smiling face, many others see a rictus and a blind stare, a visage which might well have been embarrassing to a shy, sensitive person.

Here, finally, is my question: Wouldn't it be more respectful of this poor gentle soul to no longer reproduce pictures of her in her weakened and vulnerable condition? If she indeed was the gentle, shy, and private individual which all accounts of her indicate, don't you think she would prefer not to have these pictures continue to circulate?

Thank you all for listening, and peace to you all.

Excellent commentary

Killing Wills

by Pamela F. Hennessy

Excerpts:

"It’s a pity that the mainstream press and media overlooked the fact that Terri Schiavo, while still in full capacity, could never have consented to the removal of enteral nourishment upon the event of a profound neurological insult. Indeed, it wasn’t until 9 years after Schiavo suffered her injuries, and at least a year after her husband and guardian petitioned the court for the authority to withdraw her tube-provided food and water, that such an act could take place and - even then - only under certain circumstances. It is, therefore, unreasonable and disingenuous for columnists, bioethicists and ‘scratch’ attorneys to promote the idea that a simple piece of paper would have circumvented the predicament that the Schiavo case triggered. It is also completely false to say that a living will, in the traditional sense, is a document crafted to protect the patient’s best interests. It’s anything but."

"In sum, a great disservice upon the general public has been committed by those promoting the idea that a living will is a means to ensure personal autonomy. Understanding that each of us holds dissimilar values, beliefs and desires, ushering people into signing their lives away under duress is something I view as a criminal act and not in keeping with the intent of the laws that allow us our own privacy and decision-making."

"A living will has nothing to do with living. It, instead, has everything to do with dying. It has to do with granting permission to others to withdraw medically necessary care from you so that you can either die naturally or die quickly – whichever comes first. For many people, the provision of artificial life support when death is eminent can seem unreasonable and unwanted. That’s certainly understandable. But, consenting to such a thing can be a hazard inasmuch as it opens the door for the removal of medically necessary treatment when death isn’t eminent."

From the above post, an excerpt from the North Country Gazette

Just how tight in that Greek fraternal organization are Charlie Crist, George Felos and Florida Rep. Gus Bilirakis along with Gust Bambakidis, older brother of "expert" witness Peter Bambakidis who was the tie-breaking physician, Greer's choice, in arbitrarily determining that Terri Schiavo was in a persistent vegetative state and should die.
