Democratic Filibuster of Roberts Unlikely

WASHINGTON -- The possibility of a Democratic filibuster against Supreme Court nominee John Roberts in the Republican-controlled Senate seemed to all but disappear Wednesday.

One influential Democrat said Roberts was "in the ballpark" of being a nonconfrontational selection. A Democrat on the Senate Judiciary Committee, which will hold hearings on Roberts' nomination, said she did not think the appeals court judge was "filibuster-able."

At the same time, a conservative group purchased TV ad time in support of Roberts. Abortion rights groups staged protests against Roberts at the Supreme Court and Capitol.

On Capitol Hill, Republicans moved to schedule Roberts' hearings and vote in a one-month period after Labor Day. "It's possible to start the hearings in August, but I think September is a preferable time," said GOP Sen. Arlen Specter of Pennsylvania, the Judiciary Committee chairman.

The Senate's Democratic leader, Harry Reid of Nevada, said he had not heard any senators in his party mention filibustering President Bush's pick to replace retiring Justice Sandra Day O'Connor.

"Do I believe this is a filibuster-able nominee? The answer would be no, not at this time I don't," said Sen. Dianne Feinstein, D-Calif., a strong abortion-rights supporter and a committee member.

Several of the seven Republicans among the 14 senators who brokered a deal over judicial filibusters indicated they thought a filibuster against Roberts would be unwarranted. Most have already praised Roberts. Their support would make it almost impossible for Democrats to carry out a filibuster.

It makes sense. If they don't filibuster, they won't get nuked.

Great to hear. Even greater to watch will be the liberals beating their heads against the wall trying to stop the inevitable.

I say we give Schumer a live microphone on national TV 24/7 for the next 3 weeks.

Not only will we have a nominee at the end of that time, but we'll have the 2006 elections wrapped up.

Can't they delay this for a long time?

Using the filibuster right now, when the Pubs are licking their chops and looking at them like dinner, and Carl Rove is laughing his ass off, just waiting, would be a dream come true. - They aren't going to grant it.

But the usual kooks will rant and rave.

We are told Judge John Roberts is a "solid" conservative. But, but, there has been absolutely no evidence given to back up that claim.

I would feel better if Bush would make available some of Roberts's writings, decisions, belief statements, etc.

Get braced for a battle in the Senate by Democrats. I would not rule out a military coup to block Bush's nominees from receiving confirmation.

I don't think they'll fillibuster but I'll make the prediction right now that Roberts won't get a single Democrat vote and some of the Rinos will go against him once it's clear that 1) he won't be fillibustered, and 2) he will get confirmed. The Dems have to placate their crazy base and if they can't stop the guy, they'll do their darndest to make him look like evil incarnate.

Delay, delay, delay. The Dems will attempt to make sure Roberts isn't seated by the Oct 3 court start date to keep Roberts from taking part in any near term cases, and try and get him to withdraw. O'Connor has said she will serve until a new justice is SEATED.

Pay attention to Dem requests for White House documents, remember Miguel Estrada nominee for U.S. Court of Appeals for the District of Columbia Circuit and potentially in line for elevation to the Supreme Court, he withdrew when these requests drug on and on -- That will be the attack plan. The White House is not going to give up Solicitor General documents, but that is what will be demanded by the Dems.

No evidence.... But Bush has made his decision, and you and I have no input anyway, so it doesn't matter what we think of this guy. The only audience that matters at this point is the Senate, and spelling out his positions to the Senate is not going to get him confirmed no matter what they might be.

We've got to assume that Bush honored his commitment to the conservatives. We'll know when this guy starts to write his opinions.

For what it's worth, I can't believe that Rehnquist would choose a clerk who did not share his basic philosophy, and this guy was one of Rehnquist's clerks.

Unless they have some kind of inside knowledge, while they obviously hope for it, there's no reason for them to think that'll be the case.

But wouldn't a filibuster be antidemocratic? Of course it's been a long time since the Democratic party has been democratic.

Well, first, the Dems have no credibility. They can say they won't filibuster, but it doesn't mean they'll keep their word.

I do think their preferred strategy is to do what was done to Estrada and currently Bolton. Delay. Constant demands for paperwork.

Lastly, I do think it's possible Roberts will be confirmed by October and without nuking the damn filibuster. The Dems HAVE to have sobered up enough by now to know he won't be the decisive vote. We need Kennedy or Liberals to retire to get that decisive vote. Kennedy would shock everyone if he suddenly veered back to supporting the Constitution.

They'll save it for the REAL "swing" vote. The question is what the RINO's will do then. It's easy enough to support someone that doesn't look to be the fifth vote. Quite another to support someone that will be the fifth vote and veer the Court decisively back to the Constitution.

He is a member of the federalist society, he is also a member of an organization for republican lawyers, is married to a pro-life activist, is a GOP campaign donor, best friends with Michael Luttig, and is being vouched for by everyone from Scalia to Ken Starr.

This guy isn't even a stealth nominee, he is pretty much and out and out conservative who is just not vocal.

More of a clarance thomas type but with more solid conservative credentials.
