White house should make the nomination this afternoon. Surely they've got their person picked. Release statement that says we're anxious to get on with the business of America, yada yada yada.

I say leave Thomas and dump the rest.

Any nominee should be grilled to see where they stand on the 9th and 10th amendments, the commerce clause, general welfare clause, 2nd amendment, incorporation doctrine, and original intent. If they don't come down on the issues like Clarence Thomas, they should be passed over. I would add Kelo as a litmus test. If they cannot manage as strong of a stand on Kelo as Justice Thomas on this issue, then we don't need that justice.

Hope we don't snatch defeat from the jaws of victory again. The traitorous 7 better fall in line!

Do they have a tie-breaker in 4-4 cases...does the chief justice get to decide or something?

You can make book on it - Bush will emulate his pappy and give us a moderate, or closet liberal like Souter. He will blame Congress, blah blah blah. Just like CFR, no vetoes, caving on nuclear option, Bolton, etc. Don't get your hopes up here folks. Sandra wasn't too reliable but she may wind up being better than the replacement.

I could go for Janice Brown to become the new chief justice.

I believe that La raza theory has been knocked down a few times.

How about nominating Orin Hatch? He's a lawyer isn't he ????? :) We need a young conservative judge who will sit on the court a long, long time.

"Today 4 Democratic Senators held a hastily arranged press conference upon hearing Justice O'Conner would be retiring. Senators Kennedy, Dodd, Reid and Turbin Durbin announced their opposition to any Bush nominee without even knowing who that person would be. Senator Kerry could not be reached for comment since he was staying at one his many mansions for the weekend".

I agree. Put her on the court and I am thrilled. You are replacing a woman with another woman, a white with an African American, and a moderate with a conservative. A home run.

It would never be Bork. In fact, I've been told that one of the reasons Bork was "borked" was because there was no way in hell the Republicans in the U.S. Senate wanted him confirmed -- so they let the Democrats do the dirty work to make sure he was rejected for "partisan" reasons.

Shout all they want. We'll be damn lucky if Gonzalez is a replacement for O'Connor. Because O'Connor is a swing voter, this could be big fight right here.
