So this decision does not apply to you if you own property there.I guess we need to come up with a full list of all the states & how well vs. how badly they protect property rights. Then we can tell which states we need to focus on.

If they take your property because WalMart can build a box store there and bring in a lot of taxes and provide a hundred jobs or so, there is only one question to ask.
Is WalMart a government entity?
If it is then it is a PUBLIC use. If it isn't, then the government is simply transferring property to a more preferred private or corporate entity.

I've been fighting with liberals and found that your post is explanatory enough...that they would finally understand.
We (if I may speak for the left in general) have been freaking out thinking this current administration is leading to fascism, for quite some time. I say this only to let you know there are more than a few of us who feel that way.
You are correct in that this isn't a conservative vs. liberal issue. This is a libertarian vs. statist issue. Fascism is wrong on every level. I personally understand conservatism and am not in favor of gun control, I insist on the preservation of property rights, etc. It's just seemed like under GWB we've moved in a dangerous direction.
Anyway, I am not surprised both the DU thread and this thread read alike. Often I think there's just a misunderstanding and miscommunication between both sides. We're Americans first and foremost, irrespective of our political ideologies, IMHO. As such, we need to ensure we don't lose the principles this country was founded on. And I am glad you RWers have both guts and guns (some on the left do as well, although you'd never know it looking at most democrat politicians). Now, if we the people can just work together...

I would say this ruling will put pressure on Pres. Bush to appoint a judge whose ideology is to the right of Clarence Thomas.
According to what was just on Neil Cavuto, it doesn't have to be a mall, condo or parking lot. It would simply be a matter of higher tax revenue.

They are tax exempt ... therefore, take the church and property, give it to an individual or 3, they build homes and pay taxes = increased revenue for the government. No eminent domain necessary.
