1) Federal Mortgage Interest Deduction
2) Federally-backed long-term mortgage loans (at incredibly low interest rates!)
3) Really swell FREE interstate highways that get you there real quick-like!!!

& The government taketh away...

I doubt that Bush will take astand - he would get hammered from his business constituency.

And what's so bad about big business? They are the employers, I've worked for big business a lifetime. Broke business' have never hired anyone. Big business = bad. Big government = good. Right?

"You simply offer opinions as to the efficacy of each power. My statement stands alone, Congress has the power to rein in the court."

I suppose that is true.
It is my opinion that were the Congress to pass a law purporting to "rein in" the Supreme Court, the Supreme Court would find such law unconstitutional.

I see Walmarts mentioned a lot today. Is the company just being used as an example or do they have a history of trying to take land?

"Indeed, while many state courts in the mid-19th century endorsed 'use by the public' as the proper definition of public use, that narrow view steadily eroded over time. ... given the diverse and always evolving needs of society." [Emphasis added].

Insane. Just insane.

No, it's classic "living Constitution"/"whatever I say it is" buncombe. This opinion could have been written by Al Gore. We have X41 to thank for this, who put David Souter on the Supreme Court.

Shakespeare got the spirit of it about right:

"The laws of England are in my mouth."

Oh certainly I agree that my suggestion is bad.
Very bad.
The proper thing to do would be to reorient the American constitutional structure to place the final authority in the elected branch, instead of where it now reposes, in the judiciary.

Given that there is no supermajority to convene a Constitutional Convention, there remain only the residual ploys and tricks that one could attempt with smaller majorities or even bare minorities to try and accomplish the main objective.

However, one of the points I have made all along is that Americans are not interested in changing the structure of their government. Given a choice between accepting judicial supremacy, or doing any of the list of radical and bad things that would have to be done in order to change the balance of power in American government, most Americans will prefer to leave the system as it is.

That merely means more of the same sort of opinion such as today's, because certainly the Supreme Court will not stop wielding its supreme authority until it is compelled to by power.

Americans are not willing to use any real power against the power of the court, and so the court will remain as it is.

Wal-Mart has a history of entering neighborhoods where they're not wanted by fronting a puppet "local" organization with $$$ that spews vitriol and propaganda at at the sheeple. These sheeple then vote to allow WM into their neighborhoods because they don't want local gubmint to "tell" them where to shop. WM builds. Downtowns die. Rinse. Repeat.

WM actually ran a nazi-style ad in Flagstaff, AZ, complete with book-burning references - "Would you let your gubmint decide what you read?" "Would you let your gubmint decide where you shop?"
Nevermind that WM censors free speech daily. But at least it's not gubmint...

I would disagree. I believe that the supreme court has always ruled more with popular opinion. While this particular opinion is out of the ordinary, the court has always seemed to follow not the trends of congress but the trends of the people.

Enemy Domain law

Very appropriate term, I will use it from now on, with your permission of course.

Early today I was angry ... now I just sit and shake my head. I own property that this ruling was made for.

Unfortunately, yes they are. I used to like Wal-Mart (and Sam's Club) until I found out they were trying to seize private property all over the country using the very method the US Supreme Court just okayed today.

But of course. Where else would you sit but the front porch, while waiting for your monthly check? Sigh. I guess I need to go to Walmart's and buy some moo-moo's. (ms?)
