Hospitals not willing to ask for papers should not complain about illegals costing them money.

But I can already hear the doctors, nurses, suppliers, contractors, pharmacists etc.. complaining when the number of illegal patients start decliningh.

After all, they are the people being paid by the hospitals for illegal's care.

Follow the money trail. Look at who ends up with the money in their pockets and you will find who is really behind government welfare programs. It isn't the poor, they don't have the political clout.

Example: The Food Stamp program is not administered by HEW but rather by the Agriculture Department, and comes under the agriculture committees in Congress because it's the farmers who eventually stick the dollars in their pockets.

Subsidized housing is promoted by builders and realty investment firms because they pocket the money. The fact that poor people benefit is just an excuse.

Medicare and Medicaid benefit wealthy doctors, hospital corporations and others in the medical industry.

Let me get this straight: they're going bankrupt and won't report their charges to the Border Patrol? What about billing their home country for the care? Even socialist Canada requires non-Canadians to pay for care obtained in Canada. It shouldn't be a free lunch and in reality its not because the taxpayers do pick up the tab in the form of closed hospitals and clinics and higher premiums for the care they do get.

They may send you a bill, but unless you're conspicuously wealthy and the bill is in the tens of thousands of dollars they are not likely to pursue it.

Just tell them you don't have the ability to pay if you don't.

The questions for immigrants relate only to the hospital getting reimbursed, not to whether they treat the patient.

Yep. Thanks to EMTALA, hospitals are obliged to treat every emergency case regardless of ability to pay. Ideally, it should cover only life-threatening cases. No person wants to see an innocent person die for lack of funds and life-saving treatment should never be contingent on ability to pay. That being said, its clear EMTALA is being abused and taken advantage of by illegal aliens to obtain free care in cases that don't fall under any definition of an emergency. And the hospital has to pass on the costs. And if they don't, they have to close their doors. Our politicians think medical care is exempt from the laws of economics. Au contraire as we've seen in the pressure exerted by illegals clogging hospitals and clinics in border states.

I doubt their claims that illegals are causing them to go bankrupt. If they are indeed going bankrupt it's probably for the same reasons that hospitals have always gone bankrupt.

But the hospitals aren't going to admit that they are going bankrupt because they can't compete with the newer, better equipped hospitals with the better doctors and without a dozen of malpractice suits pending.

New hospitals look like luxury resorts, complete with gourmet menues and expensive wine lists. When a third party is paying, people are going to go to the new hospitals.

Everyone is starting to abuse ERs, not just the poor or immigrants. Immigrants just learned about to free medical care sooner than others because they were referred their by other providers.

The only people who won't end up abusing the program are those who already don't pay for medical care because they have out patient insurance or Medicare/Medicaid.

At least the waiting periods will get longer and longer as the abusers increase. At some point a middle class person will pay a clinic rather than wait eight hours to see a doctor about her yeast infection

BS. Once again you fly in the face of logic. Every ILLEGAL immigrant thread you have something to say, always for the illegals. The hospitals in Southern California that went bankrupt did so because of illegals that were not paying their bills not because they couldn't compete against other hospitals fairly. The hospitals further north haven't went bankrupt because the illegals don't make it that far in the same numbers. Illegals are a drain on our society and will continue to be until we get people with you attitude out of government. I am sure you are an illegal or related to several, if not you are just very ignorant of the real facts.

That wouldn't happen because of federal rules alone. But knowing how liberal California is, it probably has laws requiring hospitals to treat indigents far beyond ERs simply stabilizing them.

If California requires for-profit hospital corporations to provide long-term major medical services to people who can't pay, then that is a California law problem, not the federal ER rule, and not an immigration problem.

Hospitals are required to provide emergency services to any human that shows up at their emergency room. If they do not supply those services, the federal government will cut off all Medicare related payments. In effect this would close the doors of all but a few hospitals nationwide.

Hospitals don't have a choice, so don't act as if they do.

It constantly amazes me that folks would publically and for posterity identify themselves with questions and concerns such as the one above.

If the 'immigrant' is legal, there would be no reason for them to forestall seeking medical aid. If they are not legal immigrants then they should understand that the 'free ride' is about to come to a halt and they are going to have to face the fact that they are not 'entitled' to 'free healthcare'.

§80.3 Discrimination prohibited.

(a) General. No person in the United States shall, on the ground of race, color, or national origin be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program to which this part applies.

(b) Specific discriminatory actions prohibited.

(1) A recipient under any program to which this part applies may not, directly or through contractual or other arrangements, on ground of race, color, or national origin:

(i) Deny an individual any service, financial aid, or other benefit provided in a different manner, from that provided under the program;

(ii) Provide any service, financial aid, or other benefit to an individual which is different, or is provided in a different manner, from that provided to others under the program;

(iii) Subject an individual to segregation or separate treatment in any matter related to his receipt of any service, financial aid, or other benefit under the program;

(iv) Restrict an individual in any way in the enjoyment of any advantage or privilege enjoyed by others receiving any service, financial aid, or other benefit under the program;

(v) Treat an individual differently from others in determining whether he satisfies any admission, enrollment, quota, eligibility, membership or other requirement or condition which individuals must meet in order to be provided any service, financial aid, or other benefit provided under the program;

(vi) Deny an individual an opportunity to participate in the program through the provision of services or otherwise or afford him an opportunity to do so which is different from that afforded others under the program (including the opportunity to participate in the program as an employee but only to the extent set forth in paragraph (c) of this section).

(vii) Deny a person the opportunity to participate as a member of a planning or advisory body which is an integral part of the program.

(2) A recipient, in determining the types of services, financial aid, or other benefits, or facilities which will be provided under any such program, or the class of individuals to whom, or the situations in which, such services, financial aid, other benefits, or facilities will be provided under any such program, or the class of individuals to be afforded an opportunity to participate in any such program, may not, directly or through contractual or other arrangements, utilize criteria or methods of administration which have the effect of subjecting individuals to discrimination because of their race, color, or national origin, or have the effect of defeating or substantially impairing accomplishment of the objectives of the program as respect individuals of a particular race, color, or national origin.

(3) In determining the site or location of a facilities, an applicant or recipient may not make selections with the effect of excluding individuals from, denying them the benefits of, or subjecting them to discrimination under any programs to which this regulation applies, on the ground of race, color, or national origin, or with the purpose or effect of defeating or substantially impairing the accomplishment of the objectives of the Act or this regulation.

(4) As used in this section, the services, financial aid, or other benefits provided under a program receiving Federal financial assistance shall be deemed to include any service, financial aid, or other benefits provided in or through a facility provided with the aid of Federal financial assistance.

(5) The enumeration of specific forms of prohibited discrimination in this paragraph and paragraph (c) of this section does not limit the generality of the prohibition in paragraph (a) of this section.

(6) (i) In administering a program regarding which the recipient has previously discriminated against persons on the ground of race, color, or national origin, the recipient must take affirmative action to overcome the effects of prior discriminations.
(ii) Even in the absence of such prior discrimination, a recipient in administering a program may take affirmative action to overcome the effects of conditions which resulted in limiting participation by persons of a particular race, color, or national origin.

Our tax increases are subsidizing all of these people.

The same happens in every sector the judical system and law enforcement sytem. We have more police officers on the street, our jails are overloaded, the drug industry has gone crazy.

My property taxes have almost doubled because of the increase in illegal aliens in Nevada. Las Vegas can't build schools fast enough to keep up with the flow across our borders. Every legal immigrant and every American childs quality of education in our Nevada schools is suffering due to this invasion.

There is not a single sector of our economy that isn't affected by the illegal aliens.

The local company where I used to buy all the tires for my familys vehicles now has entirely swapped out the crews to Mexican workers. The owner told me that these men work for less wages and no benefits. I wonder what happened to the American men. I no longer do business there.

Federal law only applies to the ER not the rest of the hospital, and only to to point of stabilizing a person. And they do have choices. Just like any business that is losing money in a certain division they can cut back on costs. ERs can reduce the number of doctors and nurses on staff, thus going on drive-by status more often and creating longer waiting times for people abusing the system>

If I knew that I would have to wait six hours to see an ER doctor about my ear ache, I'd be sorely tempted to cough up the money to go to a doctor's office.

Again, look at your state, municipal and hospital districts for rules that are requiring hospitals to go beyond what the federal government requires.

One of the advantages of winning elections is that the winners get to make the decisions. Before becoming a U.S. Senator, John Cornyn was elected Texas Attorney General. (I know the antis think he's a OBLP whatever)

One of his rulings:
"Cornyn's office said the only free or discounted services that could be provided to those who are in the country illegally are emergency-room care, immunizations and treatment for communicable diseases and child abuse. "

"Members of the Montgomery County Hospital District Board of Directors reluctantly cut health services to more than 400 illegal immigrants to comply with a ruling by Texas Attorney General John Cornyn. "
