So what was yeaterday and last night all about? Blustering?The deal expressly had the 7 dem signatories agreeing to invoke cloture on the three judges which right then signalled the end of the filibuster for their nominations.

We are about to tip the balance of power in the appellate judiciary in our favor for the first time in decades. That's plenty of upside, as far as I'm concerned Three judges are going to do that? Assuming we get the three. If the dirty 7 vote no on confirmation, we don't even get that.

That's why Leahy or whoever asked "How many votes does it take to invoke cloture?" Guys like Kerry want to be able to vote "no" on principle, but the Rats DON'T want cloture to fail, 'cause they know we'll go nukular.
