Why vote on cloture instead of just voting on the nominee? Because cloture is the question on the table, left over from last night. They could have done it by unanimous consent, but they do need a vote of some sort to be able to move on to the vote to confirm.

Why would a Myers or Bolton cloture violate the MOU? Bolton isn't up for judge so that's outisde the agreement. RATs declare Myers extreme and they are in compliance with MOU. Frist says all nominees get an up or down vote. The MOU means squat. If it comes to a cloture vote, either it passes and they get to the nominee, or Frist gets out the Constitutional Nuclear Byrd option.
Bolton and District court judges aren't part of the deal, because the DEMs haven't obstructed taking votes on them. If they do, well, we'll see what the GOP does.
