Frist will force the issue to a vote. There is no guarantee that the Constitutional Nuclear Byrd Option will pass, but the Senators will be on record.
I'm not sure how much is lost if that vote failed. The base would be very angry at the Senators who voted against it. You think they are pissed today, whoa! And you can bet they know it, now. Nope. The next time this comes up, the battlefield is a completely new one. If the DEMs retain the tool of minority obstruction to the president's preference of officers, then the Constitution will have taken a big hit.

As I understand it, it is not written that the Deal is off if a filibuster occurs--but that may be implied.
The "deal is off" if and only if a sufficient number of the Dirty 7 declare it to be off.
In other words, Frist would have to garner 50 Votes to sustain a point of order challenging the judicial filibuster. At least 2 of those votes would have to be from among the Dirty 7.

I am trying to cheer myself up too and remain positive. We need to laugh like crazy at stupid things like The Three Stooges or some of the typo's that freepers make. I have LOL so much today I have a tummy ache. When freepers get mad and try to vet they type too fast and give us endless hours of hysterical laughter. That is why even the gloom and doomers tickle the hell out of me.

Neither you nor the rest of the moderate Republicans have any idea where this is going. I hold a fairly important party position in one of the Mountain States. In that role, I'm in charge of the get out the vote effort for the swing county in that state. In 2004, I ran an organization of hundreds of volunteers for get out the vote here. A few observations:
(1) Moderates do not participate to any significant extent in get out the vote campaigns. At least 85% of my volunteers (and probably a lot more) were from the very conservative wing of the party;
(2) Of those participating in the gotv campaign in 2004 here, the number one issue was judges and they watch that issue very closely. They were out walking in 10 degree weather to get a supreme court that does not ram the East coast multicultural agenda down their throats as constitutional law.
(3) If yesterday's compromise is a predictor of how the supreme court nominees will be handled, things look pretty grim for us conservatives. The logic is straightforward. Currently, the Court has three conservatives and six liberals. Given the resignations coming, we have to run the table, or things stay just about the same on the supreme court. We are losing one conservative and may have two more appointments coming up. To achieve a conservative majority on the Court, we need to bat 1.000 on the three Supreme Court nominees. Without a conservative majority, NOTHING will change on the Court and America will continue its steady leftward drift by judical fiat. So you can see why, on this issue, we are sensitive about compromise. If its we get 2 and the RINO's get 1, we have lost completely and the loss will be there for 20 years as the new supreme court keeps moving our nation ever leftward.
(4) In 2006, I am going to have to recruit volunteers to, again, walk precincts in ten degree weather. If the R's don't win this issue 100% (for the reasons I discussed above), it's not at all clear to me that the volunteers will be there. I will be looking at a deeply reduced volunteer base. (The moderates won't step up, despite their glorious victory yesterday. They never do.) And, I cannot say that I blame them. They will have walked for two straight election cycles to achieve a conservative supreme court and then watched as their leaders threw it away. Why work to reelect the same ol' same ol' and to achieve nothing? I'll be hard pressed to counter that argument because, right now, there is no counter. Yes, I can talk about the war on terrorism and taxes and the modification of the bankruptcy act and tort reform. What has happened there are good. But if I cannot make a good case on judges, I won't be doing much convincing because without a conservative supreme court, the rest of it is fingers in the dike.
Conclusion: The Republicans are looking at a collapse of their GOTV effort in 2006 unless they very rapidly repair the damage the moderates did to their party yesterday. Otherwise, 2006 is shaping up as a repeat of 1992, when conservatives stayed home in disgust over Bush I's reneging on the no new taxes pledge.
