Why is that? Why is impossible for the President to put up anybody other than a squishy moderate?
Say the President puts up a principled conservative. A clone of Robert Bork, (or maybe Bork himself!). The Democrats and these "moderate" Republicans will no doubt consider this an "Extreme Circumstance" and will we are back to square zero. But this time, the coalition to preserve the unprecedented filibuster has already been forged. There is no way these "moderates" will vote for cloture or to change the rule. Not with the Supreme Court on the line.
In order to be approved, a Supreme Court nominee will have to be acceptable to the Republican Majority and five Democrats. This eliminates anybody who supports limits on abortion, support for the 2nd Amendment, or a reasonable reading of the Commerce Clause, just to name a few issues.

I intend to remind everyone over and over again as the next general election comes up exactly how useless they are when it comes to actually standing up for a constitutional issue. The DEMs and the 7 RINOs, and no doubt more, are not respecting the nominations power granted to the President, but ONLY IF they don't vote on the nominee.
Right now, Frist is saying he will continue to stand up for, and demand a vote on all nominations. The debate and vote has not been conceded.

And they never will be. The "real" filibuster no longer exists, and hasn't existed for years.It exists. It just that lazy Republican Senators did not want to bring their sleeping bags to work, did not have enough stregth of their convictions to inconvenience themselves.

I believe Meyers and Saad will receive up and down votes.
I heard Susan Collins say that the use of the filabuster was unacceptable and overused. She said she was highly upset over the treatment Miguel Estrada got.

You need to spend more time reading a dictionary. Start
with entries on "denial" and "naive". Wake up. The Marxists control the Senate. STOP looking at the "letter R" and start looking at actions. Realize that the Republican'ts are RAT-like. They are in bed with the RATs, the act like RATs, they vote like RATs and they are RATs in disguise as Republican'ts. You might try looking up "paranoia" and "stupidity".
BTW, John Warner last night said he wasnt goign to vote for the Constitutional option. That meant Frist never had the 50 votes he needed. The Dems lost.

I guess that is a logical way to view it.
On the other hand, Dems are never logical - or fair.
I guess time will tell if this was a very clever manouever by the Repubs and I will have to eat my words - which I would do gladly - EAGERLY, or just another case of McCain et al pandering to the libs and media.

I just watched again the press conference of the 14 compromisers, and one thing stood out from their comments:
Two senators (Mike DeWine and Lindsay Graham) clearly stated that they were ready to vote for the constitutional option, and would still vote that way if the "extraordinary circumstances" clause was abused, and any new nominee (including SCOTUS nominees) were being filibustered improperly.
Bottom line is that all judges from now on should be getting an up or down vote, or the deal falls apart to our benefit.
The Democrats get to kill the nominations of Saad and Meyers and the concept of the preservation of the filibuster. We get all other nominations to an up or down vote (where almost all we be confirmed).
This seems to be a face saving deal for the Dems, and I can live with it. Getting the judges on the courts is ultimately the important goal.

This reminds me of the Gingrich-Clinton backdown.
We have been holding our powder long enough. We have given the GOP, the senate, the house, the Presidency. We have 55 senators. It is not about holding powder, its about taking defeat out of the mouth of Victory. It is about allowing the enemy to escape to fight another day. And...
It is about the President not being in the front lines on this issue. He goes to Calvin College and talks about service, which is all nice and pretty but he needs to help Frist out.

There is no way these "moderates" will vote for cloture or to change the rule. Not with the Supreme Court on the line. Then there was no way they would have voted for cloture without the agreement. Nothing has changed except Dems get a little cover to allow Senate to get its work done.

I suggest you read the deal again. The seven RINOs have unconditionally taken the Constitutional option off the table until after the 2006 mid-term election. Unconditionally. All the RATs have to do is play the "extreme" card on ANY judge they want and the RINOs CANNOT cry foul because they agreed that the RATs have the right to vote their "feelings." If one of the seven suddenly develops a spine and cries foul, the RATs will pounce on that person and give them the same treatment Carville gave GHWB when he compromised on his "read my lips" pledge. As you can plainly see by all the commentary on FR, the base is not going to support these 7 RINOs. The RATs are salivating at the thought of 7 bare-knuckle primary fights that will clear the way for them to take the seat and control of the Senate.
