Senate Debate on Nominations Today the Senate resumes debate on the nomination of Texas Supreme Court Justice Priscilla Owen to the Fifth Circuit U.S. Court of Appeals. Mr. CORNYN. I ask unanimous consent that when the Senate completes its business today, it stand in adjournment until 11:30 a.m. on Monday, May 23. I further ask that following the prayer and pledge, the morning hour be deemed expired, the Journal of proceedings be approved to date, the time for the two leaders be reserved, and that the Senate then return to executive session and resume consideration of the nomination of Priscilla Owen to the Fifth Circuit Court of Appeals, provided that the time from 12 noon until 1 p.m. be under the control of the majority leader or his designee and, at 1 p.m., the Democratic leader or his designee be recognized; provided that floor time then rotate between the two leaders or their designees every 60 minutes until 4 p.m., at which time the majority leader or his designee be recognized until 4:45 p.m., to be followed by the Democrat leader or his designee from 4:45 p.m. until 5:30 p.m.

Mr. CORNYN. Mr. President, on Monday, the Senate will resume consideration of the nomination of Priscilla Owen to serve as a circuit judge on the Fifth Circuit Court of Appeals. Monday will be the fourth consecutive day the Senate considers the Owen nomination.

Over the past 3 days, a number of Members, on both sides of the aisle, have come to the floor to speak on the nomination. We have conducted over 25 hours of debate, and we will continue on Monday. Moments ago, we filed a cloture motion on the nomination, and that will ripen on Tuesday of next week.

On behalf of the majority leader, I remind my colleagues the leader has announced our next rollcall vote will occur Monday afternoon at 5:30. That vote will be on a motion to instruct the Sergeant at Arms to request Senators' attendance. Senator Frist will have more to say about next week's session on Monday.

CAPITOL HILL -- The Senate is gearing up for an all-night debate ahead of a critical vote on the fate of the judicial filibuster.

Custodians rolled cots into the Strom Thurmond room as the Senate convened for what will be a lengthy session.

A dozen moderates are running out of time in their effort to hammer out a compromise to avoid a vote on triggering the so-called nuclear option -- given that name because of the sweeping impact it will have on how the Senate does its work.

The Senate Republican leadership says the president's judicial nominees shouldn't be filibustered, but deserve an up-or-down vote.

Democrats say the filibuster is the only tool the minority has.

Senate Majority Leader Bill Frist's timetable calls for critical votes on one nominee, Texas Supreme Court Justice Priscilla Owen, to be cast tomorrow and Wednesday.

Owen's nominated to the Fifth U.S. Circuit Court of Appeals in New Orleans.

Chuckie's up poking at charts.

I just had a thought. If a President elected with 51% of the vote, a Republican majority in House and 55 Republicans in the U.S. Senate are not a mandate to put conservative originalists on the Court...

Then a Democrat minority in the House, alternating powers bewteen Reps and Dems in Congress, and a president elected with less than 50% of the American people's approval (twice) in time of 'peace and prosperity' without a credible challenger in the second race doesn't have the mandate to put a Ginsburg on the courts.

I probably could have explained my post a bit better. To sum it up the senate has the right to change their own rules and it's happened with all parties. If the Rats don't like the nominee then don't vote for them but give them a vote. If the Rats try to stall legislation then they may even become as relevant as the communist party in America.

I think Warner could care less what his constituents or the Republican Party thinks. While I am sure his narcisstic self is enjoying the attention but I look for him to vote against us. He's working with Byrd on compromise. However, he has gotten plenty of pork for his state so far this year. We'll see if he has any honor.

This is sooo true, especially if you consider that intellect, character, oratory skills, compromise, decency and integrity are all tools available to Senators.

And obstructionism was a key factor in bringing Daschle down in SD. I say make them filibuster - for real - for at least a week or two before going nuke.
