Pay no mind to these sanctimonious 12 Senators. They have no power if Frist stands firm.
Frist simply says to McPain and the 5 other traitors, vote against the nuclear option- if you dare.
The justification that a filibuster will thwart extreme candidates, is a false issue. A TRULY extreme candidate (NAZI) won't not be nominated; and if so, not confirmed.
The sanctimonious 12 are just trying to be power brokers, and straddle the fence as is their modus operandi. Frist should call the bluff of the Sick "GOP" 6, and thereby, get them on the record. We can take it from there.

I agree with the point about changing the rule. If the filibuster (constitutional or not) is a measure of the intensity of passion within the minority, then the desire to change the rules is the measure of intensity within the majority to support their position.

It means that Congress could "vest" (delegate) appointment power of lower appealant court judges (exclusive of the supreme Court) in the President alone by writing such a law.
Don't look for Congress to approve a law which takes that much power away from the Senate, but it could be done. Likewise, in the subsiquent congress, such a law could be repealed as any law can be repealed.
