C. Borden Grey just pointed out that IF the fillibuster option really WAS available and had been used before the Dems would have used it on Clarence Thomas! It wasn't and they knew it -- so that's why they had to produce Anita Hill and trash Thomas that way.

wow, Chris Matthews is actually saying the Dems have gone too far - they have changed the rules to say that any judicial nominee effectlvely needs 60 votes to pass now. john breaux was stunned!

Boyden Grey making a good point - saying under these rules, Thomas certainly would not have been confirmed for SCOTUS (he didn't have 60 votes)

WHOA! Chris Matthews just went to the NUT of the issue.

Breaux was trying to justify the Dem filibusters and said Clarence Thomas would probably be filibustered for Cheif Justice.

Boyden Gray pounced on the reference to Thomas. He pointed out to Chris that, if filibusters were the norm, Dems would surely have filibustered Justice Thomas. But they didn't...because that wasn't tradition then. A light went off over Chris' head as if he'd never heard that comparison. Chris Breaux: "So that's it, the Dems changed the rules!"

Breau mumbled around until Chris closed the segment by telling him:

"THE DEMS NEED TO WIN MORE ELECTIONS. GET YOURSELVES MORE SENATORS AND YOU WON'T HAVE TO PLAY THESE GAMES."

THAT is what I've wanted pubbies to say for a looooong time!
You want to control the Judiciary, get enough to be in the majority. You want to control floor votes, get more senators!

Someone needs to phone or email the pubbies in the Senate and tell them to use that one on the Senate floor
