I was listening to the talking head of Katie Couric's this morning, and she was interviewing Gwinnett County District Attorney Daniel Porter. I wasn't paying too close attention, but I heard her ask something about getting Miss Wilbanks some psychiatric help... and I heard is response as "You cannot help someone until you get them under the control of the courts."

The last thing I would want to do would be perpetuate untruths. I don't mind being corrected when I am wrong.

I haven't followed the story that well, and was unaware of Mason's character and reputation. Thanks again.

Yes, the courts can do anything, including sentence an innocent person to a horrible death without due process.

Rogue Judge Greer retained the estranged husband Michael Schiavo as Terri's guardian even though he had vested interests (was even suspected of trying to killer her) and a live-in mistress. At the same time he excused Michael and his mistress Jodi from having to give depositions.

In Washington state a judge ordered a parent from listening in on the phone coversations of a minor w ho was potentially in danger from a predator.

The monies spend in the search occurred prior to her report. See how sticky it can get. BUT, If I were her boyfriend/fiancee, I would slap her silly!

You are absolutely correct. Unless someone is under the control of the courts, I don't think they would have any authority or right to get someone or force someone to get psychiatric help. If I wanted help for my loony aunt I would not go to the DA's office.

You obviously have never been to a wedding where the families are active in several large Churches.The grooms church averages 1500 people on Sunday.The Grooms parents church as well as the brides parents churches probably are a similar size.I went to a wedding of 2 young people that was this large recently but 6 or 7 ladies from the church handled the reception.

She had moved her stuff into the home that week in preparation for the wedding.

That isn't a problem. However, if she was living with him for the week before the wedding (do we really know she wasn't sleeping there?) - I would think he would be severely conflicted and feeling guilty because of his role of leadership at the church. He would know this is wrong for him. By leading the youth, he is held to a stricter standard and needs to avoid any appearance of evil. The fact that so many assume they were shacking up before the wedding leads me to believe they weren't careful enough to avoid the appearance. He said himself that she was commuting to her job now, implying she was staying with him.

Just another angle of issues he may be dealing with personally.

Probably just a misstatment, if that. I heard the ABC GMA version of the interview this morning, and in THAT interview, the discussion went from Diane's question about "do you think she really should do jail time", and his reply was something like "people need to understand that the charge is different from the disposition. If convicted, it's certainly reasonable for the courts to impose counseling/treatment in lieu of jail"

Not to endorse the "nanny state", but I think the context was to imply that "just because she might be charged doesn't mean the goal is to throw her in the slammer".

The DA was merely stating the obvious. You cannot force an unwilling patient into psychiatric care without a court order.

Someone on here said her boyfriend's church was small. I personally don't care if she has her wedding at the Sistine Chapel. I do care that she worried a lot of people, including her family, and that she wasted a lot of police resources and then had the nerve to report having been kidnapped!

This is not exactly how the exchange went. The DA was talking about what potential legal options he might have and then Katie piped up with something like "but doesn't she really need help" and the DA basically said that in order to get her help, she would have to be under the control of the courts and he also used that line to explain how they would get her to pay restitution. What he meant is that no one can FORCE the lady to get help even if she needs it, but if she is under control of the courts, the court can force her. That's what was meant.
