The Sheriff himself explained it best: "He's got his story, we've got ours and that's what the criminal justice system is for -- to get to the bottom of this,"
The honorable sherrif takes the word on ten illegals over the word of a military seviceman. I hope the sheriff and his posse are afforded the same respect when testifing. Let's all start believing the criminal suspects when it's their word against the sheriff.

It's not what I hope that matters. I'm sure there were a lot of people who 'hoped' that O.J. wouldn't be sued in civil court for what he did to his wife - that doesn't mean he shouldn't have had to face responsibility for what he did, even though he got a free pass from the criminal courts.

18 USC 241 said an alien is protected by the constitution; but I don't think this applies to illegal aliens. The law doesn't address illegal aliens.
Your term 'illegal' modifies the term 'alien'. Thus, whether legal or 'illegal', an alien is an alien under the statute.

Fortunately, the Arizona statute
A.R.S. §13-3884 had presidence in this situation.
A private person may make an arrest: 1. When the person to be arrested has in his presence committed a misdemeanor amounting to a breach of the peace, or a felony.
2. When a felony has been in fact committed and he has reasonable ground to believe that the person to be arrested has committed it.

If arpaio (lowercase intentional) wasn't given so much publicity, would he continue to quietly do his job in anonymity, or shrivel up and die like an unwatered weed?
It seems prudent never to stand between him and a camera/microphone.

Especially after he shot off his mouth on national radio and television. Those are very good questions, are there any lawyers around who can answer? My guess is that he may be more venerable in civil court on a slander/libel charge.

Sgt. Haab was released from jail a week ago on $10,000 cash bond. Does a "cash bond" mean that he put up the cash himself, or is he out $1,000 or so to a bail bondsman? I hope the former. If it's the latter, we should take up a collection for him. If we do, I'll pledge $25. If I didn't that "Support the Troops" car magnet I have would be just so much hypocrisy.

What puzzles me about the story is that even after their confrontation was over, the perp continued the encounter after they had retreated into their vehicle. The perps were the illegals, not Haab. He arrested people involved in human smuggling -- not exactly a traffic-ticket offense.
