MESA, Ariz. (AP) -- Seven Mexican men who say they were held at gunpoint in southwestern Arizona by an Army reservist gave authorities differing accounts of the incident, according to police records.

In a report released by the Maricopa County Sheriff's Office on Tuesday, all seven immigrants say they were held at gunpoint and ordered facedown to the ground, but their stories differ about what happened before that.

"They seem to be all over the place," said David Cantor, defense attorney for Sgt. Patrick Haab, who is stationed Kalamazoo, Mich., and charged with seven counts of aggravated assault for the April 10 incident.

Some said Haab, who served two tours in Iraq, took the keys from the Chevy Suburban in which they were sitting, while others said another man Haab summoned took the keys.

One of the immigrants said a second man, whom authorities are still trying to find, pointed a gun Haab gave him at the group.

Haab was released from jail Thursday night on $10,000 cash bond.

Haab told authorities that he drew a pistol to stop a group of men from rushing him at an Interstate 8 rest stop. The men later were determined to be illegal immigrants from Mexico.

Sheriff Joe Arpaio said Haab also gave differing accounts about the incident first to dispatchers and later to investigators. Haab only claimed he was acting in self-defense in an interview with a sheriff's investigator, Arpaio said.

The investigator wrote that when he pointed out an inconsistency during an interview, Haab invoked his right to a lawyer.

"He's got his story, we've got ours and that's what the criminal justice system is for -- to get to the bottom of this," Arpaio said.

Cantor said Haab didn't mention the self-defense in the earlier phone calls because he "cut to the chase" in his conversations.

Haab is from New Paris, Ind., and is assigned to the Army's 415th Civil Affairs Battalion from Kalamazoo, Mich. He currently lives in Mesa.

- Sheila Herring, a police officer, was shot to death by an illegal alien after responding to a shooting by the same illegal in a bar;

- Ruben Morfin, 13-years-old, gunned down by an illegal alien gangster;

- Seven people were killed and 31 injured as a van full of illegal aliens tried to avoid capture by driving into oncoming traffic in San Diego;

- Two men killed and 20 injured when a stolen truck filled with illegal aliens tried to escape authorities;

- Will Seuis, Oakland policeman, killed by an illegal alien in a hit and run accident;

- Michael Gordon, policeman, Chicago, killed by a drunk driving illegal alien; another officer in the car was also injured;

- Terry Dilks and Lisa Dilks, shot multiple times and killed by an illegal alien in their home in Urbandale, Iowa; and

- James Lee and Emillia Lee, married just six weeks, killed by a truckload of 17 illegal aliens traveling at 90 mph trying to escape police near Fort Huachuca.

This list just barely scratches the surface of crimes committed against Americans by those who are in this country illegally. Certainly America has its share of crime problems, many of which are caused by liberal social policies, but the crimes listed above would not have happened if the elected officials of both parties in this country had the spine to do what is necessary to protect Americans.

Charges Dropped Against Accused Vigilante

(CBS 5 News) - The Maricopa County Attorney has declined to press charges against a man accused of holding 7 illegal immigrants at gunpoint.

The case had garned national attention with people divided on whether Patrick Haab was a victim or a vigilante.

County Attorney Andrew Thomas decided that Haab was making a lawful citizen's arrest and did not commit a crime.

"This is not a green light to intimidate, threaten, or detain anyone merely suspected of being in this country illegally. Mere presence in the U.S. illegally is a crime, but not in itself a felony, so other factors must be present in order to justify a citizens' arrest. In this case, the other factor was the human smuggling," Thomas added.

Thomas urged citizens to recognize the risk of making a citizens' arrest, and reminded the public that the right of citizens' arrest is available under very specific circumstances and if engaged in unlawfully will result in prosecution.


I quoted the Arizona Revised Statutes and Federal Statutes last week upon which the County Attorney based his decision. I was right. Human trafficking is a Federal felony and will be a State Felony within a couple of months (the law was passed and signed and only has to take effect). Haab was NOT a vigilante, but was performing a lawful citizen's arrest of human traffickers.

BP asked the aliens if they wanted to press charges against the Sgt. They did. Thus, he was facing charges.

This is no different than the Local Police force asking apprehended bank robbers if they want to sue the FBI. I think the reservist ought to sue the Border Patrol, and the agents involved should be arrested for conspiracy to violate his civil rights.

And they make up less than 10% of the U.S. population. In states like Arizona and California the number of prison inmates who are illegal aliens is closer to 40%.

And you can bet that's only some of it.

There has been for quite a few years a serial killer working the border town illegals. It'll be interesting to find out who it is if they are ever finally discovered. Odds seem to me to favor someone who blends well into the illegal community, i.e., an illegal himself.

I say 'himself,' because as we all know, only males are serial killers. Any female mass murderer must have been suffering from postpartum depression, or shock over being raped, or something that completely excused the fact she went out and killed a bunch of men. /sarc

Ahhh...but they do have rights- it was determined in the late 70's that illegals have the same civil rights while in the US as US citizens have. The determination was used in a Federal court US-vs-Hannigan.
I don't remember if this came about by an executive order issued by Carter (as I remember it) or by judicial interpetation as my friend remembers it. The Hannigan's were acquited of criminal charges involving illegals; State of Arizona-vs-Hannigan and the Federal Gov't tried them (retroactive) for violating the civil rights of the illegals in Federal court. In the Federal case the younger brother was acquited & the older brother was sentenced to prison. His sentence was upheld on appeal so it is still the law as far as I know.
