The complaint addresses the issue that if indeed she did make any statement to Michael Schiavo prior to her “accident” in 1990”, it must be made clear that prior to 2000, a feeding tube was not legally considered “artificial means” due to process and language. “Therefore, she did not have informed consent that she could not/did not have an understanding that the determination of artificial means would include a feeding tube after the year of 2000”, the complaint says.
“Her inability to be appropriately informed and her lack of decision making capacity combined with her inability to divorce her husband due to her incapacitation has placed her in a situation where she is being discriminated against by the courts due to her condition”, the federal complaint charges.

Yup. The Schindler lawyers were certainly outlawyered in the first trial, the Schindlers had a very hard time even finding a lawyer to initially take the case, while Michael Schiavo had the settlement money to go lawyer hunting. The Schindlers' lawyers are much better now, but they are still behind the eight ball, since the 'facts' of the case are now established legally. I just hope this reviewing of the facts works.

remember, there were some Tsunami victims found 2 weeks or longer .....you know what..I think they wanted to live no matter how painful rehydration was....
if Terri suffers more, its not us that are doing it......its the courts hijacked by one MS that has put her thru this wringer....
remember...the parents wanted custody of Terri long ago....

Wouldn't take a whole for any attorney to be smarter than Gibbs IMHO! Worst pleading I have ever read and I used to work for scumbag trial lawyers but they won their cases unfortunately.
Reminds me of the old joke about growing old!
