Hours after a judge ordered that Terri Schiavo was not to be removed from her hospice, a team of state agents were en route to seize her and have her feeding tube reinserted -- but they stopped short when local police told them they would enforce the judge's order, The Herald has learned.
Agents of the Florida Department of Law Enforcement told police in Pinellas Park, the small town where Schiavo lies at Hospice Woodside, on Thursday that they were on the way to take her to a hospital to resume her feeding.
For a brief period, local police, who have officers at the hospice to keep protesters out, prepared for what sources called ``a showdown.''
In the end, the squad from the FDLE and the Department of Children & Families backed down, apparently concerned about confronting local police outside the hospice.
''We told them that unless they had the judge with them when they came, they were not going to get in,'' said a source with the local police.
''The FDLE called to say they were en route to the scene,'' said an official with the city police who requested anonymity. ``When the sheriff's department and our department told them they could not enforce their order, they backed off.''
The incident, known only to a few and related to The Herald by three different sources involved in Thursday's events, underscores the intense emotion and murky legal terrain that the Schiavo case has created. It also shows that agencies answering directly to Gov. Jeb Bush had planned to use a wrinkle in Florida law that would have allowed them to legally get around the judge's order. The exception in the law allows public agencies to freeze a judge's order whenever an agency appeals it.

"A mentally retarded 4 year old could debate you and win." LOL, and you should know.
It doth get kind of creepy sometimeth, though. I'm fervently hoping (I was going to say 'praying', but I'm under the impression that some folks believe that they're the only ones qualified) that some of these folks mean well and are just coming across as artificially fantatical due to the 'cb radio syndrome' where you get to be somebody else online.
Are you not holding Jeb Bush responsible for not saving Terri?
well I think it is disheartening the way it ended up....I thought Michael should have given up guardianship along time ago to her parents...and I thought they should seek remedy from the court, but once ruled on.....I'm for following the law....go back and read the original thread, it was about a Police showdown and that is what I wrote about......this thing as usual turned into a "don't kill Terri" thread.....while noble, there are plenty of other threads to post about that on......this one was not that but I guess I got distracted by those who made if such....yes we have to follow the law......hell, I didn't agree with the OJ Simpsom verdict, but I was not going to go and hunt him down and kill him......I had to accept the courts judgement and move on.........
Well, I guess I'll have to wait til tomorrow or the next day to hear your brilliant analysis of why Jeb's oath doesn't compel him to enforce Section Two of the Florida constitution.
No, it happens after the Millennium.
Yes you are.DCF was going to use emergency removal procedure to go in which does not necessitate court order.
Greer enjoined FDLE and other law enforcement from acting.(they are under executive control of JB)This is what I meant, It is beyond his jurisdiction to tell them not to act.
If there was a hurricane tonight,in Pinellas county and JB called National Guard Greer has no jurisdiction to say no you can't go.
even if I request it?
Hullo, uh, yeah, I think the point people are trying to make here is precisely that perhaps this is not what Terri wanted. I'm not sure if you are paying attention but michael schiavo hasn't exactly been coming across as the most credible, loving husband.
the answer to your question is Islamicist Fascists terrorists have a belief systme that says you can murder innocents....I don't agree with your definition of evil here....I said we have to accept the courts decision....just like in the OJ Simpson case.....or do you think we should hunt him down and kill him......
THIS IS UNBELIEVABLE - THIS IS AMERICA NOT CHINA!
I know that, and like a gentleman Bush then appealed it up the food chain and the Court Cabal slapped him down clear up to the SCOFLAws.
If Bush defies the order on the grounds that it is illegal it is the Legislature, not the courts, which will try the offense (impeachment proceedings).
my sentiments exactly....I need more wine to continue debating some of the extreme views presented here tonight.....LOL.......
Only if he was an unbeliever, then he could claim that by Satan's rules he won.
