Schindlers' Options Dwindle to Hearing Tonight with Federal Judge (Motion DENIED)
AP ^ | March 24, 2005

Posted on 03/24/2005 4:45:17 PM PST by West Coast Conservative

A federal court hearing has started in one of the last effort attempts by Terri Schiavo's parents to restore their daughter's feeding tube.

But the judge already has turned down the parents once. Bob and Mary Schindler are asking for an emergency order to reinsert the feeding tube in the brain-damaged woman.

The hearing in Tampa is before U.S. District Judge James Whittemore. He turned the Schindlers down once, as did a federal appeals court and the Supreme Court. A state judge, a state appeals court and the Florida Supreme Court also have all come down on the side of the husband, who wants to let his wife die after 15 years in what some doctors call a vegetative state.

The latest defeat for the Schindlers was today when a state judge said he won't go along with Governor Jeb Bush's request to order the feeding tube reinserted. The governor had said that new allegations of abuse of Terri Schiavo need to be investigated. The governor also tried to challenged the diagnosis that Terri Schiavo is in a persistent vegetative state.

Hey sink, ping me for the brawl next time. I have tried to simmer down Vince, but he is bound for glory. I hope his wife posts when he dies for liberty.

I don't mean to be flip when young men are dying for liberty right now. vince 's threats are hot air. If he wants to die for liberty, he ought to join up with our young men who are doing just that.

The issue here is clear: Does the legal branch have superior authority over the legislative and executive branches?

Yes. It is clear more than ever that there is a turf battle coming between the Congress and the Courts. Perhaps not with this case. But it's coming soon IMO. The Congress will have to break the current penchant of the Courts making law. In the US Constitution, there is actually very little language spent on the Judicial branch. But there is plenty paid to WE THE PEOPLE (the elected Congress). A showdown is coming, and it's long overdue. Too bad it won't be right now.

That said, I pray for Terri's soul and for her family. I now believe that she is an Angel sent from Heaven to wake us from our slumber. After Terri has gone to be with The Lord, WE THE PEOPLE who remain have a lot of work to do.

Flip THIS on, David Allen has a guy from the Thomas more law center, on saying this shouldn't be looked at as a "right-to-die" but rather a ciminal case.

During the Governor's news conference, Hannity kept talking over the Governor and then assured everyone that the feeding tube would be reinserted in 24 hours -- mind you that was Hannity not the Governor.

Felos judge-shopped the case to Greer.

Felos told Greer to issue his recent restraining order.

All rulings in the case are Greer's--picture him at the bottom end of the pinball machine.

They can throw him in jail, throw him out of office, use his abuse of power to besmirch his programs that are helping Florida, and then reverse his actions and kill Terri anyway thus making it so he accomplished nothing while paying dearly.

These "upset people" are turning FR into a laughingstock with their red-faced rants.

To whom, and why do you care?

Let me guess..

And they don't see a connection between a little boy being forced to go back to a communist country...

and

A young woman being starved to death??

And that folks, represents our tax dollars at work.

Hannity just said this has been a series of disappointments for the Schiavo's, and it sounds like the fight is over.

I don't see this posted on this thread yet. Hannity just announced that Whittemore has refused to overturn Greer's order.

Interesting information. Calling him a probate judge is picking only one of his juridictional duties, completely unrelated to the Schiavo case, as a label. His duties clearly include guardianship matters which are central to this case.

I don't know how they assign cases in Florida, but he was certainly among the pool of those who would hear this case. The fact that he hears probate matters is a deliberate red herring.

I wish both sides in this case would quit the deliberate spinning. The issues deserve to be understood without the misrepresentations that abound.

People like you and others with new screen names sit behind a computer and type all this crap up against Jeb and the President. Why aren't you down there in Florida protesting? Easy when no one knows who you are to say what someone should do like break the law isn't it? If Jeb did break the law, my bet is you and others criticizing him would jump on the bandwagon to remove him. Did you criticize Janet Reno for ordering people to go in at Waco? I know I sure did.

Funny. terri's brother and sister just credited Jeb Bush for being a strong advocate of terri's, and said if he could act they believed he would. I certainly didn't hear the FAMILY calling him a coward.

God bless Sean Hannity. He has been a stalwart in this entire case. He meets with the family every day and really has taken this case to heart and done everything possible to help the family. I just don't know how he puts up with Allan.
