Actually, since there is no ruling on the dispute over Terri's Law, as Dr.Bennett pointed out, there is

NO CONTROLLING LEGAL AUTHORITY

To wit: The Legislature, and the Executive and the Judiciary are CO EQUAL Branches of Government. Two Branches out of Three Currently agree on Terri's Law. The Supreme COurt in Refusing to issue a Decision in THAT case, let stand an Impasse between three CO Equal entitites.

The Florida legislature sought to keep Terri alive, or at least postpone her death, by authorizing the governor to issue a one-time stay in order to prevent the withholding of nutrition and hydration from anyone under certain and extreme circumstances. "Terri's Law" was signed into law by Governor Jeb Bush in October, 2003, but soon after, the Florida supreme court struck down the law as unconstitutional.

Clearly, Governor Bush believes "Terri's Law" to be constitutional. Not only did he sign it into law, he later challenged the decision of his own state Supreme Court by appealing to the United States Supreme Court. Unfortunately, the U.S. Supreme Court would not hear the case.

In theoretical terms, this is a conflict between the separate powers of Florida government, as the judicial and executive branches have different opinions about what the Florida constitution requires. But in practical terms, Terri's life hangs in the balance: If the Florida supreme court prevails, she dies. If Governor Bush prevails, she lives. It is a mistake to believe that the courts have the ultimate say as to what a constitution means.

People like Rush are to comfortable with and dependent upon the status quo to advocate anything like that.



Plus Rush has is own legal problems in Florida. He does not want to cross the Bush's at point. Now, Michaeal Savage this past week on his radio show has let it all hang out. He has so far given both Bush's some slack, but if they let Terri die he may vent.

And I'd like to add, that blaming GW or Jeb for the outcome of this is akin to blaming Ronald McDonald when you get a bad cheeseburger. The angst is miscast.

Understood. I want her to live and I'm frustrated, too - I'm just as frustrated, though, by the breathtakingly hyperbolic attacks on George W. and Jeb Bush - not by the left this time...by the right.

I was not arguing that the ceding of power started here. Elected politicians of various stripe have long been using the courts for cover on difficult political issues, from the beginning of the Republic through slavery to affirmative action to gay marriage to capital punishment to Terri Schiavo. One principal difficulty is that, when anyone calls out the Republican emperor for being buck nekkid, he is accused of helping "the enemy" by fracturing "the party". It seems to me that in many cases, in the immortal words of Pogo, "We have met the enemy, and he is us!"

AMEN to your post.

A woman just told Rush she thinks government involvement to save Terri's life is "further invasion of government into private lives."

Rush disagreed and I concur: The invasion HAS ALREADY occurred. We've got to PUSH THEM BACK. Lawfully. By impeachments, recalls, rescinding unGodly and antiGod laws etc. and SYSTEMATICALLY BOYCOTTING the Left's sources of financial and nonfinancial support. One of the sources we MUST shut down IMMEDIATELY is the Civil Rights law loophole under which the ACLU is continuing to enrich its foundation, at taxpayer expense.
