Thomas Sowell said recently that the law is a cruel and blunt instrument, and we are seeing this demonstrated.

There is justice, and there is that which comes out of law courts and the second is only an approximation of the first.

(Now, I am not a "death troll" and have been very active in the pro Terri corner of the world - I am just summarizing!)

BECAUSE Terri was certified by the court as being in PVS, and BECAUSE Terri was certified by the court as having expressed a wish not to be kept alive if she were incapacitated, by the laws of the state of Florida, her wishes are being fulfilled and the power of the state is being used against any and all who would stand between her and her wishes.

Therefore, Jeb's desire to free her is considered a legal violation of her rights.

Therefore, extending her life to investigate abuse done to her is a legal violation of her rights.

This is what happens sometimes when people get caught up in the legal system. Even if they had gone in yesterday and taken her because the DCF wanted to investigate abuse, unless they had really compelling evidence of collusion to declare her pvs or hard proof of perjury on those who testified to her wishes, I doubt if they could have done more than kept her long enough for a court to throw out their actions.

They might be able to buy her a couple or three days. That's about it.

There is justice, and there is law. I have a feeling here that justice is not being done, but I do believe the law has mostly been followed. And if not, action will come later, not sooner.

Lord have mercy on the hardness of men's hearts.

That's my understanding, too. That DCF can act, the judge might rule later. I realize he might then rule against them, but my feeling is that the important thing to do right now, regardless of what happens later, is get Terri rehydrated. Save her now, deal with what comes later. It seems like almost everyone in this sorry affair is waiting for her to die so that they don't have to act.

Also ... why claim its "euphoric"? I thought Terri is a "vegtable", and she can't feel anything.

We all know what Greer will rule.

I don't doubt it. But the case shouldn't end there because I think Governor Bush can appeal it to the FL Supreme Court. That should produce an automatic stay on any order issued by Greer.

Earlier this morning, Greer vacated the automatic stay on his injunction against DCF taking custody. The automatic stay occurred when DCF filed an appeal in his court. I think the stay would be restored on appealed to the Supreme Court. If it does, a window will open where DCF can take custody.

Greer might be stalling in order to try and engineer an immediate vacate order from the FL SC, but I don't think they'd do that.

Call me naive, but perhaps it's a good sign the ruling has been delayed. It seems to me if Greer were just going to deny the request without much thought, he would have done so already. Perhaps he's finding a way to grant the request while still saving face. Again, I'm probably being naive.

Call me cynical, but it may be that Greer is dragging his feet to ensure a Culture of Death "victory".

I just got off the phone with the governors office in Florida giving them my two cents worth. She told me that the judge (Greer) has already denied the request. I asked her to clarify which request, and she said the one that was being decided today over DCF. For what its worth. Anyone able to back this up?

Actually, if the judge rules against you then you lose, and the other side wins. You have to appeal, not them

If Jeb asserts that he has the statuatory power to take custody and then does it - not asking for permission, just doing it, it will put the shoe on the other foot.

The courts will then have to answer the question "did the governor exceed his authority" and, until that appeal process completes he can assert that he's not gioving up custody.

Am I missing something?
