It sounded to me like the governor listened to the news conference that Jeb Bush had yesterday and struck first: barring DCF from getting involved.

You and me both -- have been talking to lawyers around here and they are appalled at those pleadings. Said no Federal Judge in their right mind would have ruled in favor of Terri and if they did they would have been an activist judge not following the law.

Makes me wonder having Randall Terry and why all the grandstanding by him with such an incompetent legal team making pleadings.

This smells!

I'm no expert, but technically I think you're right. DCF can act without prior court approval, but according to the law in FL they do have to go to court within 24 hrs of taking someone into protective custody. I think Gov. Bush was looking for some cover here. Also, if he took her into protective custody and 24 hours later Greer ruled against him, he wouldn't have achieved much.

The governor has satutory power from the laws of the State of Florida to take into protective custody any adult or other person who is being abused on in danger if they cannot speak for or take care of themselves. In an emergency situation where the life of the victim or their health is at risk, he can do so without a court order.

The DCF has indicated that they believe, as a result of the investigation into abuse allogations by Michael and the hospice, that this is the case. As a courtesy he has given Greer a chance to rule. He should have, IMHO, acted immediately after his news conference yesterday...but here's the rub, if he had, he would have had to obtain a court order within 24 hours, excluding weekends...and he would have had to get it from Greer.

So, Greer would have to issue the order anyway today. If Bush goes in today, he buys the weekend before Greer must sign the court order..and maybe by then he can get Greer removed based on his actions. I do not know...I just would like to see more time purchased for this innocent woman.

Perhpas after taking her into to custody...they ould lose her in the system (wouldn't be the first time something like that happened) and she could end up in a more life respecting state that would not send her back to Greer.

I do not know. I know Greer and Michael are both hopelessly conflicted in their interests. Greer should have recused himself long ago, and Michael should nno be the guardian. Perhpas thye have the goods on these guys and are going to bring it all tigether. I do not know...I do know that Governor Bush said some great things yesterday, I cannot believe he would say those things and then not act.

I totally agree with you.The reluctance of so many judges to step forward and provide relief from execution by starvation of an innocent woman,through an equitable remedy on compassionate grounds,scares me to no end.This case has proven that the judiciary has lost its justice.It will die too by the way begause of this.

If Bush can go over the head of the UN and attack Iraq, why can't he get the balls to save a simple life that is being condemned to death because she happens to be innocent of living?

Right on. Why should US troops die in Iraq if the US President is not willing to save Terri From State Murder dictated by Judges.

It is an interesting point: Seems that State of Florida court decisions re: Elian were not acceptable to the Clinton Administration OR to the mainstream press, so forceful intervention was justified. Now all we hear about is how the Feds should kowtow to the Florida courts.

The irony, of course, is that the Gonzalez incident probably cost Al Gore the state of Florida in the 2000 election.

Yes and he could have done that yesterday, but Jeb decided to wait for this hearing.

IMO it was all for show.

Is it true Greer was a board member of the hospice? I know that Felos was a board member but when Terri came to reside in the hospice, Felos resigned. The reason Terri came to reside at the hospice is because a doctor claimed she only had 6 months to live. That was 5 yrs ago. I don't know it just seems all the players in this story are connected in some way and some form to this hospice. It is all very fishy.

I believe it was Felos' request to roadblock DCF

If Bush DID ask Greer I think it was just a courtesy

Bush ALREADY has legal authority for DCF to act.

Talked to a couple lawyers here who have tried cases in Federal Court -- said a law student would have done a better job. Said the biggest mistake came in their appeal to the 11th Circuit to have the entire Circuit hear the case -- at that time the pleading could have changed for them to review the other. They took 10 hours to turn in another wrong pleading -- same at the SCOTUS.

Yes, storm the place. What kind of country do we live in where you can't give a citizen a glass of water? Greer deserves to be held for 30-days without food or water - let's see how the black-robed one likes that!

I don't understand the basis for this "euphoric death" theory. Have they surveyed people who died of starvation, I mean let's get real...hunger and thirst HURT. In a devastating way. No euphoria whatsoever at any phase, and it's so much B.S. that they are promoting about this.

But judges take excremental representation into account all the time, don't they? Which is part of the reason why there are so many people sitting on death rows around the country? Why is that judges worry more about perps having bad representation than they have about Terri Schiavo?
