State could rescue Schiavo despite judge's denial

The Florida judge who has consistently ruled against efforts to keep Terri Schiavo alive has said no to an effort by the state's Department of Children and Families to rescue the brain-injured woman by physically removing her, but a department spokeswoman says the state agency still could take action without judicial approval.

Pinellas Circuit Court Judge George Greer said the state cannot take Schiavo into custody, nor provide her food or water.

WFLA Radio in Tampa says the ruling will likely be appealed.

The possible "rescue" scenario emerged today with Schiavo now in her sixth day without food or water.

Florida's DCF indicated it might remove the brain-injured woman, by force if necessary,

let me rephrase that... they can file but nothing will be acted on until DCF gets in their paperwork.

I agree that most likely Governor Bush is waiting for the US Supreme Court to turn the case down, then when all of her parents avenues have been exhausted, he will send the State Agents to get her. It is my hope and prayer they act swiftly. In a few hours it will be Holy Thursday, where we remember Jesus' Last Supper and His suffering in the Garden. The closer we come to the Good Friday and Easter, the more Christians are understanding that this time and place in history for this fight is God's fight. There are too many coincidences. I wish I lived in Florida. I would be in jail tonight. Then I would have felt my conscience clear that I tried to save Terri. I know we all feel so helpless in watching this atrocity being inflicted upon this woman by our government.

The police in Florida are arresting children and grandmas for the crime of trying to bring a glass of water to a thirsty woman.

Jeb Bush or George Bush need to put Terri in protective custody, and they CAN do it. They should stop waiting for something to happen. Time is going to run out if they don't act soon.

We the people gave the executivew the power to save the life of a criminal through executive clemency, even after they have been tried by a jury, convicted by the jury, and have exhausted all appeals straight up to the highest court.

I don't think it would be a stretch to say that the same executive could use the same power to save an innocent person that has been denied the most important piece of this puzzle, the jury trial; especially since the US Constitution prohibits the taking of a life without due process of law, and that due process includes a trial by a jury of peers.
