State could rescue Schiavo despite judge's denial

The Florida judge who has consistently ruled against efforts to keep Terri Schiavo alive has said no to an effort by the state's Department of Children and Families to rescue the brain-injured woman by physically removing her, but a department spokeswoman says the state agency still could take action without judicial approval.

Pinellas Circuit Court Judge George Greer said the state cannot take Schiavo into custody, nor provide her food or water.

WFLA Radio in Tampa says the ruling will likely be appealed.

The possible "rescue" scenario emerged today with Schiavo now in her sixth day without food or water.

Florida's DCF indicated it might remove the brain-injured woman, by force if necessary,

Let's all back up for a second. Do you all not think Jeb Bush, who has been the most consisten outspoken public advocate on this, is not seriously pondering this option? You all act like he's sitting around and doesn't care. He cares and is trying to come up witht he right thing that will have the most positive effect. He has to weigh his decisions and how it would play out. Some of us act like he can just do whatever and all--anytime you're essentially going to defy a court order (which It hink he should), you have to think it through just a tad. He's going through every last hoop available. I believe in my heart Gov. Bush is doing his very best. I think the demonizing of him on here--he's our main ally--is unfortunate. Without Jeb, there is no chance here.

Good point, that never occured to me, but the analogy is a good one. I am going to stay up a while longer cause if Jeb is going to do something then waiting much longer is counter productive. Tongiht would be be night if he meant what he said. This is an excellent time to observe the characther of a man that may one day ask for my vote. Got any balls Jeb?

No one is bad mouthing Jeb, and Jeb is smart enought not to open his mouth with idel threats without thinking things thru first. I think Jeb will make his move tonight, that is why I am staying up.

I've not been demonizing him. I've simply been reminding him of his Executive powers and DUTIES that are included in his oath to uphold the constitution of the State of Florida.

Section Two of that document is unequivocal in it's defense of innocent human life. It even explicitly includes the disabled.

The Fifth Amendment, which everyone seems to ignore, is also clear as could possibly be. A ten year old can easily understand its meaning.

It's too late for "pondering", the woman is near death now. Action, and only action, is what is needed now.

the deal is if DCF goes in without a court order. They have to file the reason within 24 hours after they take her into protective custody. DCF was there this evening and looked her over. If they go in sometime on Friday to take her into protective custody, they will not have to file with the courts until the following Monday. This will give them more time to run tests (evidence) on her and so forth.

They also may be waiting until the very early morning hours to do it when the cameras are off the crowd outside the hospice is small to prevent other people from possibly getting hurt or they are waiting to hear what the Supreme court says if they come back with a ruling early in the morning.

I can see many reasons why they have not busted down the doors and taken her just yet, but I feel they will.

I thought I read on here that doctors had said she could live a week or two. Could it be that they will wait until the date the doctors mentioned to fully justify their move without question as it was mentioned by the doctors as how long she could live.

I must get to bed. Can't make sense anymore.

Thank you Bridgette. I posted a question concerning this, because the media is reporting now nothing more can be done outside of the Supreme Court. I wish Drudge would post some of these articles. He seems more interested in the Spring weather tonight.

Good point on a friday move, but I think the judge could/would work the weekend to enforce his ruling. Better point on waiting to hear from the USSC, that I will buy.

Thanks Mike, I have heard much trashing of the Governor on other threads. Jeb has been a steady moving force throughout this.

Even if he ultimately fails and I pray he does not, he would no doubt be mournful but would have no reason to blame himself.

That burden is on those who compelled him to intercede.

they cannot file until DCF files the full reason, so DCF can drag their feet during the weekend if they like.
