As pamlet pointed out to me above, Friday is not a legal holiday for Florida. This means in order to take advantage of that clause they'd have to wait for Friday to take her. That can't be what the delay is because I can't imagine they'd make Terri dehydrate any further just to buy one extra day. My suspicions were off.

my understanding is that once DCF files everything starts back to square one. It will be taken in front of another judge. But we must not forget about the law that congress passed this weekend about how everything must be looked at from the beginning.

It is now Thursday, but Good Friday is not a government holiday, but it may be a state holiday. Does anyone know if it is a State Holiday for Florida?

haven't heard anything except that someone said a florida lawyer disagreed on Greta that they could take her.

Tonight on hardball...Pat Buchanan said that President Bush and/or Governor Bush CAN exercise their executive power and remove Terri....and he was very angry and was saying that they HAVE to do...you should have seen him, he was great. I think they are just waiting to see where we get with SCOTUS..they won't let her die, if they did they would pay a huge price as would the GOP

I do have faith in those cowboys and their inner values and strength.

Hoping it's a case where they have crossed all t's and dotted all i's, so when they are forced to ride in and save Terri, no one can rightfully say that they acted precipitously

that's ok, we don't WANT Terri at that steenkin' place. She needs to be removed from that area to a saner place, "saner" being a relative term here.

Please tell me this doesn't mean Michael could sue some doctor for his "wife's" wrongful death! If this could help the parents, great, but Michael???


BUT I do hope the Schlinders do have an unlaw death against Michael,Greer and Felos

Family Services can go to evaluate, but can't remove her by Florida law, when the endangered person has a legal guardian. The guardian would need to sign off on it.

Not when the person suspected of doing the abuse or endangering IS the guardian!

Florida's DCF indicated it might remove the brain-injured woman, by force if necessary, from the hospice where she has lived the past five years.
Department secretary Lucy Hadi told the Palm Beach Post her staff is relying on a state law giving authority to intervene on behalf of a vulnerable adult "suffering from abuse or neglect that presents a risk of death or serious physical injury."

Hadi said DCF must file a petition to remove Terri Schiavo from the Pinellas Park, Fla., hospice but could take action without judicial approval if the department believes it's warranted.

The law says emergency medical treatment can be given to the vulnerable adult as long as "such treatment does not violate a known health care advance directive prepared by the vulnerable adult."

The court history would not prevent DCF from taking action, however, according to Hadi.

"We're not compelled to look at prior judicial proceedings," Hadi told the Post. "What we're compelled to look at is the presenting circumstance and any allegation of abuse and neglect that we've received. So we have to deal with those and fulfill our statutory responsibility, notwithstanding anything else that may have gone on before."

She insisted the court decisions upholding Michael Schiavo are questionable.

"There's nothing about this case that has been clear-cut, except our concern," Hadi said. "We're doing everything we can to be of assistance."
