State officials say they are considering removing Terri Schiavo from hospice, by force if necessary, despite numerous court orders upholding the removal of the artificial nutrition tube that has kept her alive for 15 years.
Lucy Hadl, secretary of the Department of Children and Families, said Wednesday morning that her staff is relying on a state law that gives the department the authority to intervene on behalf of a vulnerable adult who is 'suffering from abuse or neglect that presents a risk of death or serious physical injury.'
Hadl said that the DCF would have to file a petition in order to remove Schiavo, but that 'it doesn't mean we'd have to have judicial approval in advance of taking the action if we believed it met the threshold for doing it.'
Hadl said that seven years of court rulings backing Schiavo's husband Michael, in his contention that Terri Schiavo did not wish to be kept alive artificially would not stop the DCF from taking action.
'We're not compelled to look at prior judicial proceedings,' Hadl said.
What we are compelled to look at is the presenting circumstances and any allegiations of abuse and neglect that we have recieved. So we have to deal with those and fufill out statutory responsibility.'

JD Alexander is my State Senator and is getting to be a real rino. He cannot win without my conservative county republican votes. He just barely won last time out,and I promised in an e-mail today to support any gop challenger to his re-election. If I am not mistaken he is a cousin of Katherine Harris. He will not be re-elected because this issue has totally defined him no matter what else he does. HE IS BRANDED BY HIS GUTLESSNESS. We need a real man to protect a lady that has been brutalized. He does not measure up.
And a lot of very stupid women take up with men with abusive histories. (Even serial killers of women get love letters!) The women , if asked if they aren't concerned about their men's pasts, usually explain smugly that the other women in his life weren't "woman enough" , "sexy enough", or were otherwise to blame for the abuse, because of their (the other women's ) deficiencies. It could never happen to THEM-they're too 'special', too sexy, too beautiful etc etc .
Thus far everything that has been done to save this woman's life has been with a deference to the the constitutional principles of separation of powers and federalism. Yet, this woman for whatever reason has fallen prey to a legal cesspool.
Barring an unlikely save from Justice Kennedy, any action taken by the Florida executive branch would be extra-constitutional. I have read the statute that DCF believes allows them to take custody of Terri Schiavo. They would be on shaky legal grounds to say the least.
At what point do you say enough is enough? This woman has a right to life. If the US Constitution cannot protect her, than natural law principles ought to. The judiciary pulls rulings out of thin air all the time, why can't the executive use precepts outside of our legal realm to save this woman's life?

The presiding Florida Judge (Greer) moments ago issued an emergency order blocking the Florida State Dept of Child and Family Services from taking custody of Shiavo with the expressed purposes of reinserting her feeding tube. The judge issued the order while he said he would review the states request for custody based on supposedly new allegations of neglect lodged against Shiavo's husband Michael and the previously discussed possible misdiagnosed of her condition. The family is also appealing to the Supreme Court to be involved in all this but legal experts that chances of the high court getting involved are extremely remote.
Have faith.. Don't let the DUms goad you into something they can use against FR. Terri has already exposed many of the corruptions of the EVIL ones. More than all the law enforcement and moral leaders in the Country. Vengence is reserved for the Good Lord. he will prevail. There are many good ppl working hard.
Just what is he risking by taking action? Impeachment? Removal from office? A chance at the Presidency in 2008? Tell me that a Rat governor would NOT hesitate a minute in commuting the death sentence of a tried and convicted mass murderer because he was against the death penalty.
Here we have an innocent women, who everyone agrees is innocent, condemned to death by a judicial system that has ignored many facts in this case, and has ignored a law passed by the Congress and the President just last week. And just like the mass murderer on death row, she waits for a phone call from the Governor. However, unlike the murderer who awaits execution at 6 a.m., we do not know the hour of her death -- it could be this evening or the next day or next week. Delaying increases the chance of her living and ever recovering.
I understand the anger but, please, that comment is too extreme...
Does DCF "have" to get permission from a judge?

What if the judge doesn't think that there is enough evidence to take the children. We know Greer didn't give a restraining to Helene Ball Mc Gee and she was murdered 2 wks. later.
415.101 Adult Protective Services Act; legislative intent.--
(1) Sections 415.101-415.113 may be cited as the "Adult Protective Services Act."
(2) The Legislature recognizes that there are many persons in this state who, because of age or disability, are in need of protective services. Such services should allow such an individual the same rights as other citizens and, at the same time, protect the individual from abuse, neglect, and exploitation. It is the intent of the Legislature to provide for the detection and correction of abuse, neglect, and exploitation through social services and criminal investigations and to establish a program of protective services for all disabled adults or elderly persons in need of them. It is intended that the mandatory reporting of such cases will cause the protective services of the state to be brought to bear in an effort to prevent further abuse, neglect, and exploitation of disabled adults or elderly persons. In taking this action, the Legislature intends to place the fewest possible restrictions on personal liberty and the exercise of constitutional rights, consistent with due process and protection from abuse, neglect, and exploitation. Further, the Legislature intends to encourage the constructive involvement of families in the care and protection of disabled adults or elderly persons.

It may very well be God's purpose in Terri's case, to focus us on the culture of death that our society is rushing towards at warpspeed, but the culpability for ending her life will lie with MANKIND, those that have insisted on pulling the plug on her, not the Lord.
