State officials say they are considering removing Terri Schiavo from hospice, by force if necessary, despite numerous court orders upholding the removal of the artificial nutrition tube that has kept her alive for 15 years.
Lucy Hadl, secretary of the Department of Children and Families, said Wednesday morning that her staff is relying on a state law that gives the department the authority to intervene on behalf of a vulnerable adult who is 'suffering from abuse or neglect that presents a risk of death or serious physical injury.'
Hadl said that the DCF would have to file a petition in order to remove Schiavo, but that 'it doesn't mean we'd have to have judicial approval in advance of taking the action if we believed it met the threshold for doing it.'
Hadl said that seven years of court rulings backing Schiavo's husband Michael, in his contention that Terri Schiavo did not wish to be kept alive artificially would not stop the DCF from taking action.
'We're not compelled to look at prior judicial proceedings,' Hadl said.
What we are compelled to look at is the presenting circumstances and any allegiations of abuse and neglect that we have recieved. So we have to deal with those and fufill out statutory responsibility.'

Sad thing though, she knows alot. I would be very careful if I was her. We know what wedding vows can do to you. She would have more rights if she stayed living with him.

I totally agree. The judicial branch has gone far too long with out any checks or balances.

I would be happy should Mr. Schiavo simply stop his cruelty and step aside in favor of her parents.

I called the DCF and got recordings that mailboxes are all full, was transferred to an 'attendant' and got another full mail box recording. Never talked to a human.
That is why we have courts to settle disputes like this. This has been to court 23 times - and counting. The supreme court - twice!
Her doctors say she is a vegetable, the husband says she would not want to live like that. The courts - over and over again - have upheld this.

Congress should cut the budget of the 11th Circuit in half. You don't have to cut the salaries of the judges, just get rid of most of their support staff.
Well said. I wonder how many of these people so fired up about this are ignoring those in their lives who need attention, too.
I care about this woman, I support her life, but I am being really turned off by some of the comments I've read.

I rather doubt that the local cops who a "guarding" Terri are all that committed to seeing her die. More likely that at least some of them would be delighted to help load her into a rescue bus. Maybe help provide escort to the border, where Georgia can take over.
